in Water bills
Is there any chance someone knowledgeable can point me in the right direction....
Basically the wife has a CCJ for water rates..courtesy of Northumbrian water ..now she has been getting the usual nasty letters threatening Bailiffs and she has been in touch with them 2 times to try and arrange a repayment plan but they would not accept anything from us ... basically its there way or the highway . I must admit I was oblivious to what happens bills wise as I work nighshsift and she is generally very good at paying the bills and most are payed by DD.
Now a letter has turned up with her old name (CCJ is in her old name as we are now married) and now threatening a warrant of execution will be placed with the court and that a repayment plan will not be accepted now.
Now if a Bailiff is to turn up I know my rights etc but most of the goods in the house are in my name although I don't have many receipts for them but the main things like TV etc I do .
Would a statutory declaration work if I was to say the goods are all in my name as there is nothing to hide as they are legitimately mine ..?
The CCJ for £243 and dates back to 2010 and is in her old name although we are now married and I assume the money owed is for the person named on the CCJ ..but now that we are married it will also drag me into it .?
I am in the process of writing a letter detailing income and expenditure and the there is another bill that needs sorted but the CCJ one is a priority for now as phoning them seems to be an utter waste of time.
Thanks

Phoning them will not work as they will more then likely not hold the account any more.
You need to arrange a payment plan with either the court, the company who are holding the account ( debt collectors ) or the water companies litigation dept but first you need to work out where the account is so best thing is to ask the water company who you have to deal with.There is a race of men that don't fit in; A race that can't stand still;

ok thank you.
Now we have another water bill which also needs sorting but we cant go the DD route with it so would it be wise to maybe ask for a water meter to be installed..? and pay something affordable back each month through Paypoint ..?0 -
I am not to good with CCJs but if you didn't know about the CCJ (all paperwork went to different address ) you can get this CCJ set aside
If they get awarrant of execution The bailiff that will turn up will be the county court bailiff (debt + fees less than £600)and he should contact you first to say he is coming. These bailiffs are much more amenable than the majority we come across
Would a statutory declaration work if I was to say the goods are all in my name as there is nothing to hide as they are legitimately mine ..?
Yes get 1 original copy and 2 notarised copy's if a bailiff does turn up at your door do not allow him access to your home hand him one of the notarised copy's dont forget to include your car (things in the garden)I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites
If you are in any doubt please seek legal/expert advice help0 -
Thanks for that halloswitch.. I was wanting a plan in place in case they do actually turn up and the kids answer the door and push past them etc..
We have just had a letter through the door about the main bill and has a income and expenditure form attached so there is some headway at least.
The CCJ is worrying but the declaration should ease the worry some what for the more expensive things with in the house as they are legitimately mine and the CCJ is in the wifes old name.0 -
You can of course apply for a meter and then the RV portion stops the moment the meter is installed. It is possible to them work out a payment plan to include the arrears on the account.
Have you looked into their trustfund to see if you can apply for that ?There is a race of men that don't fit in; A race that can't stand still;

We are not eligible for the Northumbrian water "watersure" thing they have.. but the meter will be a must I think. Not sure I like the way the bill is worked out on closer inspection.0
