This looks like fun - I am going to crack open a packet of Hob Nobs and enjoy the read.
  • In our contract it states that as a van user we have to pick up and drop off, keep the van clean and tidy, and not to be used out of work hours.and if you say your not going to travel some place to pick up another person that lives miles from you,you are told its in your contract to pick them up.
Please don't start to argue as we need all the help you can give us, I am in the ucatt union but trying to get to talk to one of them well I've more chance of chatting to tony Blair.

SarEl is female; SarEl doesn't have a law degree - she has four law degrees; and she has been a barrister specialising in employment law for more than 30 years.

I refuse to engage in this thread any further. I have outlined what the legal position is, as requested by the OP. If they would prefer to believe the advice they like rather than the advice that conforms with the law then that is their concern.
  • 1. Sorry to gatecrash the Clique then, I'll leave you two to cosy up to onme another. :o
So because I suggested that you had got your degree from Kinder it's a clique - but when you thought I was talking about SarEl it was oh so relevant?
If you haven't got it - please don't flaunt it. TIA.

At no time have I made unwarranted or deliberately inflammatory comments which consist of little but personal abuse. Unlike our new poster here who seems to think this is acceptable behavior. Nor have I done anything except answer the OPs question and to correctly state the law. I have pointed out that common practice with other employers in the sector does not make this the law. The interests of the OPs friend are best served by not getting him sacked for demanding rights that he does not have. In fact I was the one patronised by comments that I didn't understand what people were saying when I understood perfectly well, and then told that our new legal expert knew it all because he has a law degree. There are a lot of people who have a law degree - and a reason why few of them are in practice.

I have not sunk to the level of our new friend - but I have reported his posts. Personal abuse isn't acceptable. And I would invite the OP to carefully consider the credibility of advice from someone who thinks it is.
  • Thanks to guys and gals for your help so far.I shall post exactly what my college has in his contract and then further help would be appreciated. Thanks again.
  • FT - you seem totally confused and don't understand what SarEl has said or indeed anything I've said.

Something definitely does not smell right. From what you have said it seems you understand nothing.
If you haven't got it - please don't flaunt it. TIA.

  • I am not particularly versed in Employment Law, my masters is in Construction Law/Contract Law.

    Quoting for future reference.
If you haven't got it - please don't flaunt it. TIA.

    6. I have no idea what you are referring to. I certainly have not patronised yourself, indeed I have been very complimentary to yourself in a number of posts. I merely clarified/explained a number of points, nothing more nothing less. You simply took umbrage and which was misplaced on your part.

Right, can i just say one thing?

And, Yes I know that acting like the grammar police is a bit out of order, especially to a newbie, but....

For God's sake, if you do have a law degree, how the hell did you get it when you use phrases like: "I have been very complimentary to yourself".

Did your tutors just accept any old draft of nonsense?

"you have been very complimentary to yourself" - Fine
"I have been very complimentary to you" - Fine

But what you used? Like nails down a chalkboard.

You wouldn't get far in my court with that sort of piffle!
