B&Q vent

Father and mother-in-law kindly bought two ovens for our kitchen, they have both had a fault meaning the knob on the oven has damaged in an identical way on both ovens, Which has worked to our advantage having two as clearly it's a fault on the oven! However they have refused to refund or replace the product even though both ovens have identical damage, We are considering taking them to court. Any advice? are we at fault or are they?

    Or it could be that you have used both ovens in the same wrong way that has caused identical damage.

    How long have you had the ovens? If it's less than 6 months they have to prove it's not an inherent fault, more than that then the onus is on you to get an independent report that says it is a fault.

    And unfortunately you can't take them to court at all as you were not the purchaser so you have no contract with B&Q, it would have to be in the names of your father and MiL.

    We have had them for around 4 months. We have searched our particular model and seen a lot of people with similar complaints. Each oven has two knobs, totalling in four, two of the four have been damaged. The other 2 identical ones are in tact.
    It's my father and mother in law considering taking them to court, I'm just doing some asking for them. :)

    I've seen it a number of times, they're usually those built in ovens that sit within the kitchen units one above the other.

    Usefull at Christmas maybe or when one breaks down -- otherwise a little overkill.

    To answer the OP...

    The retailer has the right to either REFUND, REPLACE or REPAIR. Which solution they apply is completely down to them.

    As the fault has occurred within in the first 6 months, the fault will be classed as inherent, unless they can prove misuse.

    I'm guessing they have said they will get the repaired for you? If they have, there is no point at all in taking them to court, you will categorically lose as they are fulfilling their rights under the SoGA...

    Good point meepster, I'd overlooked that the OP was only talking about replace or refund, I imagine that you're right that B&Q have offered to repair and that should be the end of it.

    Before I moved into this house there were eight people living here, They are built in units but they proved very useful at the time. :)

    They have refused to refund, replace, repair or take any action whatsover, After numerous visits to the store and on the telephone to customer services we've been brushed off with various reasons as to why they won't take any action.

    What brand are they? What is the "fault" exactly?
    If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

    What reasons have they given? If it's that you aren't their customer, then they may be in the right and it might just be that you need the parents to get involved. If they are claiming that you have misused the ovens, then it is up to them to prove it.
