Unfair Parking Charge

I recently received a parking notice charge for not displaying a permit in a secure gated private residential car park. The charge is £60 if paid within 14 days. Issue - i am a resident with a valid parking permit and was parked in my designated space but failed to display it on this occasion. Naively i contacted the parking company without reading up on this beforehand and appealed whilst admitting that the permit had slipped off. They still insist I pay the charge. I then disputed this further on the grounds that the charge is excessive and not a reflection of loss to the landowner who i'm already paying anyway for the right to park, and that i am not in breach of my tenancy agreement. The company replied saying they do not support multiple appeals and their decision is final. What should I do? Ignore? Do they have any legal standing against me?? I haven't received any formal letters yet or any photographic evidence of the offence.

    purely and simply ,,ignore,, all you have recieved is an unenforceable invoice=parking charge notice=loo paper,,,now if you had recieved a ,,penaly charge notice,issued by police/traffic warden,,,that is the legit one,,,a parking charge notice is not worth the loo paper its written on,, now relax,chill,dont worry,, and ignore all the threat o grams threatening court/bailiffs/etc etc,,it will not happen,as if it went to court the judge would tell them where to go,they know it,we know it and now you do.keep your money,,absolutely no contact with them or others acting on their behalf,,its a scam and not legit.

    Obviously ignore it. Forget what you've said to them already, it's done no harm but you really did take this too seriously didn't you?!

    Once you have seen the preview of the letters to expect and ignore, and when you have seen the Watchdog clip on a top thread by Crabman, you WILL be certain about it I am sure. Read the 'stickies' (info threads at the top, but not Park Right as that one's irrelevant) and then read on down the thread list, click on ANY other threads you like.

    In fact there have been threads like yours before and it's been pointed out that where you have a designated space then the PPC is trespassing against your goods by touching your car - you don't even 'have to' accept a poxy permit scheme - I wouldn't if it tried to supercede my rights within my lease!

    The PPC probably only have any lawful permission (from the landowner or managing agent) to carry out their worst in any COMMUNAL areas, because your tenancy rights - and those of your neighbours - protect the other spaces. They quite probably should never be going near your designated bays as they may well be stated as yours by right, in your lease/tenancy. Check it and quote it at your landowner/agent (not the pathetic third party scam company). Quite possibly, the PPC and the agent/landowner who contracts them to issue these pathetic threats are in breach of your tenancy agreement! Had you not thought of it like that?

    Of course you can ignore the PPC now; the question ''can I still ignore them even though I have already ''appealed''? (;)LOL @ 'appealed'...:D) is asked a lot:

    That link will only last for a limited time as the question comes up so often the search result will change & no longer work. I just searched the sub-forum for keywords 'already appealed' if you want to repeat the search. Read any result that's NOT about a Council (real) PCN, as they are different.

    Ignore the scam PPC completely from now on. But do read up on the scam and watch the Watchdog clip if you've not seen that already, and get a preview of the letters to come. They really are easy to ignore when you can just play snap with them compared to the pics in the top thread. And read your lease details about your space/right to park a car there - consider a complaint to the landowner/managing agent and withdrawing from the stupid [STRIKE]'permit scheme' [/STRIKE] money-making scam.

    It does show what idiots these PPCs and the management companies that employ them are . Why on earth would you need all this rigmarole in a secure gated parking area? It's not as though a random motorist is going to casually drive in and park there.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?

    Can I ask do they have signs that say they could clamp? If they do make sure you have an angle grinder at hand if they try doing it, obviously parking in your own parking space means there can no possible loss to the landowner, so it will never go to court.

    I remember a thread going back some months ago about a guy being harassed in his own parking space, getting invoices almost everyday and they were gluing the demand onto his windscreen, he was actually the person who owned the land ! Wonder whatever happened to him, it went as far press articles in the local rags
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?
  • Yep - they do have signs saying they will clamp but not seen them go that far yet. Quite ridiculous really!

    If they clamp you over this invoice you can legally cut the clamp off.

    So you need a permit to park in a secure gated car-park? Surely if you have the means of getting access to the car-park means you've got a right to be there. It's not like John Smith looking for somewhere to park his car for free to avoid paying for parking can drive in and park up.

    Ignore the demands, if they are stupid enough to try court they will be thrown out
