won appeal

  • she is not sick now, ahe was when she was told in october. when won her appeal.
Supposed to be made redundant yesterday (last day) but she won appeal. They said the process wants done up to the standards expected in the company and there was no evidence for her low scoring (she has an evidence to prove she was really good in her job), looks like manager basically didn’t like her, comments were personal.
So there are 3 options, old job back, new job or package…. Old job would be under the same manager so HR didn’t recommended this choice. Her department will be closing down in 2014 so she could have job for another 3 years, so maybe she should ask about 3 years salary? Because if not unprofessional manager she could have this job for another 3 years. And they admitted in writing process wasn’t done up to the standards and wasn’t fair.
I thought this case is strong?!

What does she want to do ? - does she want to return to work for the same company but in a different department ?

You/she can ask for whatever you like - but it doesn't mean that is what you will get.

Ps - if you manage to negotiate 3 year salary payment then please ring your local Woolworths and warn them that I am on my way to stand in their front window to show my bare backside !

She is expected to mitigate her losses, not to have them pay her for the next three years! Hence, a reasonable settlement would consider how long it may take her to find alternative employment, which as noted earlier, would be months not years.
  • she wanted her job back, but HR does not recomm, this choice. the said about package, didnt say how much. So thats why I am asking how much she can expect or how much she can ask for?

So the choice is between, old job, new job, or £6k.

As I said last night, see what they offer and then look into how much is suitable. You do not make the first offer, they do.
  • £6 was the redundancy, now we are talking about package on the top of redundancy.
  • yes you right better just wait and see... just dont want her to take bad offer ;)

OK the person made a mistake but what are they likely to be like going forward.

Are they the sort to forget it and carry on as normal or try to get her out.

Take the job if it three years more money and three years more service for a bigger pay out them.

What about the offer of a trial back at the old job with the option to go in 3 months if it does not work out or if another job comes up the option to move to that.

I think the minimum extra would be to take account of the 3 years service as if she had stayed, so extra notice and redundacy.

    How was the £6k calculated.

What 'package on the top of redundancy' has she been offered?
