Uncancelled phone insurance

Insurance I took out on at Carphone Warehouse in 1998 has been running for 6 years on a redundant phone. Apparently there is no onus on CPW to make contact with the client after the policy has been taken out. Although, of course, more careful checking of my banking statement would have revealed my oversight earlier so would some form of communication from the company. I have been trying for over a year to get them to agree to a refund for 4 years premium. Has anyone else had a similar experience?

Hmmm...very difficult as the T&C's will be in their favour.

The onus would have been on you to cancel the policy - CPW will argue that as far as they are concerned, you still had the phone & still wanted the cover as y ou didnt inform them.

Unless they decide to offer you some form of partial refund as a gesture of 'goodwill', I wouldnt be overlu optimistic.

When I originally discovered the oversight CPW offered to send me a "refund pack" and verbally agreed to refund me. I wonder how many others have taken out insurance and forgotten all about it when replacing a phone.

CPW have a habit of making things up on the phone just to get rid of you.

If T&C in a consumer contract are ambiguous or unfair then there are ways to legally get CPW to give you your money back. See if you get the refund pack in the post if not post here.
