    As I said early upgrades have always been at the discression of the network, it's never been a right.

    A techncial fault is not a lie. You were told it was error, have lost nothing and any other network will be exactly the same.
    Do you by chance work for a mobile phone company?;)

    Consider buying the phone sim free, it costs more but you can then get a lower sim only tarrif.

    Talking Iphone, cheapest 16gb 4S is £30 per month, plus a up front fee and it usually works out around the £900 total cost mark for 24 months.

    Sim Free they cost £500, Contract £240 on Giffgaff or £300 on Tesco, saving money and you can change at any point which may be better for a child who wants the latest phone. Down side is the upfront cost.

    Fortunately, my daughter is after a Blackberry 9360 which I have seen for sale for around £230-ish. As you say, at least buying the phone sim-free gives the option of upgrading the phone earlier than the 24 months. Will just have to find a company where I can get cashback on the phone and SIM only contracts to offset the Vodafone early termination charge.

    Why not ask Vodafone to change the current internet allowance to a BB one for the remainder of the contract ... then use it with the new phone. Once the contract is up you can move or negotiate a sim only contract.
