Hi,
Can anybody help me?
I wrote to my bank to claim approx £750 in bank charges.
They've written back and offered me approx £550 (without prejudice).
HOWEVER, on the acceptance form at the back of the letter which they've asked me to sign and return if I accept their offer, the amount shown for me to sign to say I accept is over £900!!!!!!!!!!!
It's obviously a typing error or they've used the same form as a previous customer and forgotten to change the amount, but my question is... does anybody know where I stand if I sign the acceptance form and send it back on the basis that as far as I'm concerned, I'm accepting £900+, despite is saying £550 in the main body of the letter?
Will the bank dispute it and say that because it says £550 in their letter, that's actually what I'm accepted, or will they have to pay me the £900+ because it's their mistake???

sign it see what they give you if they give the £900 they are unlikly to ask for it back its there error
or if your worried about it leave the rest in your account for a few weeks incase they want it back after a few wk and nowts happend spend it :-)0 -
It unlikely that they will refund the wrong amount, however if they do they will ask for it back.0

Hmmm, thanks, that's what I thought.
My concern is that if I sign the Acceptance Form and send it back, they'll realise their mistake and just credit me the £550, which I'm not prepared to accept.
Strangely enough, this was the second letter I've had from them essentially saying the same thing... I had one last week dated 9 February and then the one I received today dated 30 January!! Very bizarre! Although it was only the one I got today that had the error on the acceptance form.
What a disorganised bunch!!!

Well you can but try! Send the Acceptance Form back and say in a cover letter that you are happy to accept £900 and see what happens... If they then only refund you £550 you can say "hey, the Acceptance Form AND my letter stated I would accept £900, you have broken your promise!" Who's to prove and how that the £550 was the intended amount and not the £900? If they are that disorganised they might not even check the original letter again and just refund you the lot... I have the same dilemma!
Only that in my case I believe my accounts have been switched as I am offered £348 insted of the asked £90!!!!!!!!
Also one other problem is that I have put my claim through Moneyclaim and the bank has acknowledged my claim! Can I stop the proceedings if I sign the acceptance form and how do I go about this?0 -
I've merged these threads as they are both dealing with mistakes in offers.
My own opinion is you if you follow the tried and tested route you will get your money back honestly without accepting something you know is wrong.
The banks will find the errors.0 -

RBS seems to make the offer after having acknowledged my claim, as I am claiming separately on a closed joint account, too.
I thought they might want to stiffle my demands by sending me the acceptance form??? Shall I go ahead?0 -

Therefore I believe that someone at RBS has made the mistake and switched the amounts on the accounts.
I reckon you are right and I should just follow through with the moneyclaim but in case I wanted to stop my claim in order to accept an offer how do I do that?

I filed a claim with natwest for £220, Natwest paid me £220 into my account, all well and good.
Today I received a check from RBS litagation department for £250??? I have no other claims, just that one from natwest.
I forgot to actually cancel the claim with the court and thats what the letter today and cheque was about0
