PCN received from TCP Advice please

Hi, Yesterday we received a PCN from a company called Town & City Parking, we were parked at a retail park (newly opened) (first ever parking ticket)

I am disabled, it is a mobility car and I have a blue badge, I use a wheel chair, and my tax disc states Disabled Exempt.

Hubby parked in a disabled space and put blue badge on front window BUT did not open the wallet and set time on clock - (never have before here, just display the badge to show we are allowed to use the space)

so anyway come back to a Parking Ticket saying we had parked in a disabled space without displaying a disabled badge £30 if paid within 14 days -

the blue badge wallet was still on display (not fallen or anything) and on the PCN ticket was written my tax disc number, so the patrol chap had to have seen it was a disabled (exempt) car - I have not paid (yet) and have appealed using the online form, but have had no reply I have sent them an email asking for them to confirm that they have had the appeal and still not had a reply -

I have read so much about ignoring the letters etc... but do i really do this?? ( i had sent the online appeal form before reading on here) What will happen??? Help !!! Please

We couldn't find the patrol officer anywhere!!! On benefits, hubby is carer, got no money £30 is half my weeks shopping!
Any advice very very gratefully received

    Your case is no different to the many others featured on here. From now on just ignore the parking company and all the silly but meaningless letters they might send you. You have nothing to worry about.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?

  • Chill.Go back out,buy a hamster and a shredder and use the letters they send you as free bedding.No they wont come to your home.
    Went shoplifting at the Disneystore today.

    Got a huge Buzz out of it.

    Go and read the sticky to see the letters you are going to get. Then ignore them without worry. If you get a different one, post it up so the rest of us can learn. :)

    They won't come to your home but some PPCs have been known to instigate harrassing phonecalls - I can't remember OTOH if TCP or their fake collectors are one of them

    The Blue Badge scheme does not apply in the context of private parking and this is clearly stated in your handbook/issuing authority website. The Equality Act applies here, so any disabled person regardless of badge/road-tax status is entitled to use the spaces .

    Remember this before pointing the finger at anyone else. Plenty of us don't have badges and pay full road tax.

    It was stupid of me to write that and I should have thought about what i was saying, Realised how that read after posting it and soon deleted it, I did not mean they should not have parked there, I was more thinking he had to be a bit daft if he gave me a ticket and as he had clearly read the tax disc, Feeling very ashamed as i should know better, I have ME and brain damage and sometimes am able to walk so don't 'look' disabled i also have an autistic daughter so i really do understand how many many disabilities are not seen, i often get asked if i have a blue badge!

    I would never ever question anyone’s right to park in a space I do not and would never ever think I have the right I feel privileged there is a space wide enough so I don’t accidentally bash my door into another car.

    I am truly sorry if I upset anyone by putting that as I really did mean it in another context, which is why I deleted it as soon as I read it through once it was posted, my brain sometimes takes a while to catch on lol Just wanted to say sorry and Thank you for advice.

    Don't worry about this, legally the invoices are just a request for payment, you don't have to accept that request, if you hadn't written to them this scam would be over quicker for you. You are disabled you are enititled to park there, if they refuse your appeal by the way you could in fact sue them for discrimination I believe CouponMad who posts on here knows far more than me in this regard, but here is link for you

    Thats a first, remember though that these invoices are not enforceable and should you get another you just as well ignore the junk mail. But well done on getting a result nonetheless.

    They are all or have been suspended from accessing the DVLA database for gross misconduct!

    It's a little tick in the box for TCP to "yes we do actually listen to appeals, so yes, please give us keeper liability as we are a trustworthy company"

    TCP patrol a supermarket car park where I live. The TCP employees, bar one, who patrol the car park are either incompetent, begging to be arrested or asking for a smack in the mouth. One nearly got a very hard slap from a motorist after claiming what was on one of their signs was "the law" and another claimed the local council owned the car park. I have documentary evidence to the contrary and took great delight in telling said TCP employee of this. I wouldn't take TCP's upholding of an appeal as evidence of them being trustworthy. Call me a cynical ex-policeman if you like, but I think you'll find they realised they were on unsafe ground legally and decided to do that rather than risk legal action or adverse publicity in the media.

    TCP's head office is in Perth, Scotland. Anyone wishing to find out if TCP have had run-ins with Tayside Police and/or the Area Procurator Fiscal could always submit an FOI request if they so desired. It would be interesting to find out.
