Hi, i received a Pcn from this company on the 19/12/2011 for parking and leaving the car park.. I went to the cash point before using the pets at home store! I appealed the ticket via email then received 2 emails both stating that i was in the wrong the matter would not be discussed again and that the charge still stood! obviously in more technical terms... then in the post a few days later i receive parking enforcement notice saying to pay £70 threatening court action and bailiffs if I don't pay?? what should i do? the last thing i need as a single parent is bailiffs knocking my door??

From now on just ignore this company, nothing will happen to you.
You seem to be confusing bailiffs with debt collectors. The latter are just private citizens with no more powers than you or me to demand money off people. For "proper" bailiffs to become involved the case would have to go to court (very unlikely) you lose (very, very unlikely) and THEN you refuse to pay whatever the judge orders within 28 days. This is such a remote possibility that it's not worth worrying about.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -

Presumably they forgot to include the part about how the law prohibits private companies from issuing penalties for any reason, let alone because you happened to step outside the boundaries of a car park. If the worst comes to the worst you'll get the pleasure of seeing a nervous, sweaty solicitor trying to explain to a judge just how his/her client thought they could get away with such a ludicrous scam.The fridge is empty, the walls are damp, there's no hot water

Ignore them of course. Has the penny dropped - you do know now that you didn't 'appeal'?! This is a fake PCN and a fake appeal process = a scam.

I just searched this part of the forum for 'Total Parking Solutions' - a search which anyone can repeat or change keywords to suit, when this search no longer works (it won't work as a link for long). Also read the stickies at the top of the forum for pictures of the debt collector scary letter to completely ignore, and for a link to a Watchdog clip showing you just what to do when you get a fake PCN like yours!PRIVATE 'PCN'? You are caught up in a scam.
The Scam works by impersonating authority and mimicking real council parking fines.
The whole show is an impersonation, it will take on many forms of impersonation and faking from parking fines to debt collectors to fake solicitors to fake phone calls from fake debt collectors.
If you Ignore them, they will make fake threats of court action.
Now lets explore this court action;
The law of this land is based upon two principles, you shall not suffer loss or harm without redress .
So if the private parking company claim they can use court action they will have to prove that your actions caused them loss.
The truth is your actions have caused no loss whatsoever to the land owner, in fact they have gained from your actions.
So is they claim money via the court they have not lost, that is called a penalty, the law states that penalties can not be charged by private companies, so any court action will FAIL.
They know this so what they will do is mount a campaign of legally borderline harassment by imitating real authority and attempting to confuse you that they are some kind of authority, in truth they are just a full of bull tin pot back bedroom scam merchant.
So Ignore them and get ready for lots of silly letters designed to make you break under pressure by confusing them with authority.
Just file them.
What I would recommend is that if what you purchased can be taken back to the shop for a refund you do so and when they have refunded you tell the shop in no uncertain terms that you have returned the goods because the private parking company have tried to scam you for shopping with them, so you will now go buy the same product at a shop that does not have scammers operation in their car park.

As the OP shopped in Pets At Home on 19/12/11 it's quite possible that they may not be able to return the goods they purchased in their original form.

Pets At Home supposedly take customer service quite seriously (I used to be a mystery shopper for them back in my student days).
Worth pursuing them to get some vouchers at least.0 -
I didn't actually purchase anything from pets at home as they didnt have what i was looking for but all the same i still went into store.. will be taking your advice and ignoring any further contact... hopefully nothing will come of it. wish me luck..0

This is a SCAM. Read the links and look at the debt collector letter-chains shown in the top thread on this board. That's what you will be sent and they are easy to ignore, I have ignored a fake PCN and letters and so have most people on this board.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Our company have just employed TPS to manage there staff car parking by providing us all with parking permits and I was unfortunate enough to forget to swap my permit into a different car and came to find a £60 fine stuck to my windscreen.
Does the same advice follow as with public car parking ie ignore it all?

Yes. And its illegal for your employer to attempt to deduct the ridiculous charge from your salary. And if they argue about it, print out and give them these:
Court ruling confirming private parking companies have no legal authority to offer parking or pursue motorists for 'charges' of any sort

Point out it is illegal for them to attempt to deduct the charge from your salary, and its also illegal to harass someone for an alleged debt, under the Protection from Harassment Act 1997 Section 2 and Section.126. They have to prove the debt in court first, and then get a court order to tell you to pay (never going to happen)

And if the parking company DO break any of these laws, point out this ruling that says the landowner is liable for the actions of the parking company, and can be jointly prosecuted and sued with them
