Peacocks !!!! up!

Options
As much as I have great sympathy with all the staff of Peacocks stores, I am now stuck with some unsuitable clothes that I would like refunds on. I bought them just 2 hours before Peacocks went into administration and so now it seems I cannot get a refund (or even exchange) in store. I have the receipt (within 28 days) with it's 'no quibble guarantee' which I feel should be upheld as I bought the goods in good faith that it would be. Even the staff had no idea that they would be told not to give refunds/exchanges during administration. The Peacocks website has a form to send off in the case of gift cards but nothing about actual physical goods.
Has anyone had the same experience.....and any ideas what to do about it?

I think you’re stuffed, Peacocks is now owned by the administrators. If they are over £100 you might try your card co. Did you buy them by post?
Do you want your money back, and a bit more, search for 'money claim online' - They don't like it up 'em Captain Mainwaring

If they have the receipt it's likely they were bought instore. (edited after the very useful post below).

OP, have a read of Peacock's Administration FAQs.

They have changed in the last day or so to allow some returns.
    Returns

With immediate effect, goods with a valid receipt will be accepted for exchange if those goods have been purchased within the previous 28 days from a Peacocks store in the UK. If the exchange item is of a lower price, no refund will be given for the difference either by way of a cash refund or refund card.

The customer may have an unsecured claim against the Company in respect of such goods that are defective, and have been purchased before 19 January 2012. Please submit any such claim addressed to the Joint Administrators, FAO Deirdre Cox, KPMG, Arlington Business Park, Theale, Reading, RG7 4SD.

The Company will NOT in any circumstances refund unwanted goods, whether these were purchased before or after 19 January 2012.

This does not affect your statutory rights.

As the clothes are just "unsuitable", then there is no hope of any help from your card co.!

But why not see if you can either exchange them for something suitable (or if nothing suitable is available), some other item which will have a resale value and ebay it?
  • In short, you're not getting a refund.

Oh dear - sadly refunds are just 'gestures of goodwill' and you have no legal right to a refund, whether they're in administration or not, unless they are 'not fit for purpose'. I guess ask for an exchange, ebay them, or see if you can do something else with them like customise them? :-(

Not necessarily correct. If the store had a returns policy, then that would be a contractual term. If they are no longer keeping to the contractual terms, then a s.75 claim would be appropriate.

Not necessarily. Putting a refund/exchange policy in place forms part of the contract, therefore a contractual obligation, which can be pursued via the courts if necessary (breach of contract).

But the fact they are in administration does change everything, they are no longer meeting these obligations, for which op may have a claim against the company -- however unlikely to be worth ops time for what will turn out to be pretty much nothing.
