Hoepfully you can clarify something for me. It's a couple of months ago so no point in following up but just read something that made me wonder whether something was lawful
I purchased some clothes for my daughter from Boo Hoo dot com. When they eventually arrived one of the items didn't fit. Labelled as a size 10, a six 6 would've been lucky to get in it.
I sent the item back, foolishly didn't realise at the time, but their returns policy is that they will deduct £2 restocking fee. Having read something about the DSR's I thought this was against the regulations.
Are they pulling a fast one? The item was rejected within 7 days of delivery

You can't charge a restocking fees for returns under DSRs, and they should refund original postage also. You may be liable for return postage costs or they may deduct the direct cost of return if they paid. That's all.

Yes I did - we emailed the day they arrived - although Boo Hoo didn't personally acknowledge the email for 3 days - although got a 'thank you for your email' bounceback0 -

Thanks for that - I've now told my daughter that she can't have anything from there anymore. I've also fired off an email to BooHoo to ask how they think their returns policy meets the requirements of the DSR's.

Actually in THAT situation the retailer may also have been responsible for the returns postage. It was the wrong size (or labelled incorrectly) hence Sold Not As Described - a Fault under SOGA.0

This has been debated a number of times. There seems to be no standardisation in sizes as far as clothes are concerned, so simply because the item was not the size op was expecting doesn't necessarily mean it's not as described. If ops looking to return on this basis, it would really depend how the item was decribed and any size guides the retailer may have on the website.0 -

Hi All - my apologies - it was within 7 working days - it was the day after we received the package
I didn't say anything about sizes etc - just that I was rejecting the goods0
