Returning a faulty TV

We bought a tv from Currys on July 23rd last year. We've just gone to switch it on and it doesn't won't work, no picture or sound.

I'm planning on taking it back tomorrow which will be 6 months to the day that we bought it. Is it up to me to prove its an inherent fault? The direct.gov guidelines state over 6 months since purchase that I have to prove it, but I'm not sure where tomorrows date lies IYKWIM

I don't want to kick off, but want to be sure of my facts. I've read the stickies but the date thing has thrown me somewhat.

    Why are you so worried? You bought a new TV that had a least 12 months warranty, so you just contact them and tell them it's broken. They will arrange to get it fixed.
  • I don't want it fixed though. I'd like a replacement or a refund. I feel that if its broken so soon then it can't be a good tv. It's only used for about 12 hours a week.

    By all means ask for a refund, but you're not legally entitled to one unless it says so in your warranty. They can also refuse to replace it unless it's unrepairable. If all they offer is a repair, I'm afraid that's what you have to accept. Sorry, I know that's not what you wanted to hear.

    Stand your ground on a replacement or repair though, you ARE entitled to that!

    Unfortunately you have no rights to expect a refund / replacement after 7 months (although you can of course ask).

    You should have no problem getting it repaired within a year, however.

    It was actually the cheapest place for the model we wanted, but normally I wouldn't shop there. I know they'll try and get out of their obligations and tell me to take it up with the manufacturer so I wanted to be sure I was 100% accurate!

    OP, I don't know the answer to your question about which side of the six month boundary tomorrow is.

    Leaving that aside for the moment, once it is decided that the fault is inherent you are entitled to a remedy.
    You can choose the remedy, either a repair, replacement or refund.
    Any refund can be reduced to take account of the use you have had from the thing.
    The retailer can refuse your remedy if it is disproportionately costly.
    In other words you will probably offered a repair.
    They must perform the remedy without causing significant inconvenience.

    There are others on this forum who know more about Currys procedures, so I'll leave that six month issue to them.

    Ok - but the point still stands.

    You can reject the goods as "inherently faulty" for a refund / exchange within a "reasonable time" (which Currys define as 28 days).

    To ask for a refund / exchange after 6 months would not (imo!) be within a "reasonable time" to reject the goods.

    Being within the first 6 months only means legally they have to prove the fault wasn't inherent, rather than you proving it was - but within the first year they should have no issues sending it away for repair anyway.
