Insurance company added fixed penalty points that don't exist.

Hello,

My boyfriend has found our a few days ago that our insurance company (we insure 2 cars with them) added to his insurance account a fixed penalty of 3 points for speeding code SP40. This was added by them in June 2008. My boyfried has never got thses points and this has been confirmed with DVLA. This means that we were overpaing our insurance premiums since June 2008.

Can someone advise me what we can do now? Where we can complain?

Thank you.

You start by writing a complaint to the insurance company, who will ignore you, then you write to the financial services ombudsman

Ask the insurer to correct it and ask if any refunds are due.

It's a long time since I had points, but back in the day 3 points made no difference to premium. This may not be the case now.

    Is this true? SP40?

That's not a normal speeding conviction. That's specifically for exceeding passenger vehicle speed limit. I've known of an SP40 conviction for towing a trailer on a motorway at 70mph when the limit for such activity is 60mph.

The usual codes are SP30 and SP50 for exceeding the statutory speed limit on a public road and exceeding the speed limit on a motorway.

    SP40 is for exceeding a 40mph limit, isn't it?

Funnily enough, a lot of people think you simply add the speed limit to the SP to make the offence code. A few years ago there was a spate of SP60s dished out despite there being no such code...

  • Thank you for all comments and advices. Could you give me more example of what "Exceeding passenger vehicle speed limit" means?

    Thank you in advance!!!

Insurance companies can make mistakes - I once went to renew my insurance and found that it included an amount for when I changed my car, except I hadn't changed it (or even looked at, considered, been quoted for, or anything else the supposed new car)! I wrote to them and pointed it out and it was resolved.

Could be speeding whilst towing a caravan (different speed limits than the norm), or whilst driving a bus etc.
