parking charge notice

We stupidly paked in a disable bay in tesco, it was far from the store and we thought it was one for families.My wife was driving and the car is registered to me. TPS notice has ticked the box - the vehicle was parked in a disabled bay without a valid disaled badge displayed. I phoned them to ask if they would provide me with any evidence of my wrong doing, they said i would have to appeal to be provided with this. which i am not going to do after reading all on this site :T. But if i recieve any letters should i ignore them ? :think:

    Ignore them, and don't do it again :)

    Yeah don't appeal to them at all, just ignore everything from them, their fake debt collectors, and the equally fake solicitors , in short there is nothing further to do unless you get signed and stamped court papers through the letterbox.
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    Not many people will condone this behaviour but as the Blue Badge scheme doesn't apply to private property in England and Wales you've done nothing illegal. Morally though you should show a bit more respect and leave disabled spaces for those who genuinely need them in future.

  • Massive thanks to you guys on here, sound advice. Got my ticket off these clowns (TPS) last June, ignored all the letters, and yes they did get more and more intimidating, but as you all urged, I kept my nerve. Just! Last letter was in October, threatening bailiffs and then court action, nothing since.

    Parking invoices are of no threat and such companies get NIL sympathies.

    However for those who "accidentally" park in disabled spots, particularly if they cannot distinguish the difference between..........

    Yes, I do agree that people should be able to spot a disabled bay pretty clearly in most private car parks and morally must surely leave it for someone who needs it. No arguments there.

    And Parent and Child bays mean nothing legally as we all know - even if a car park was busy I wouldn't use one now unless I was with my youngest son or younger relative.

    But that big 'Badge Holders Only' sign gets my goat! :mad:

    It actually discriminates against the very disabled people who may be entitled to use the bays. Shocking that we see that sign in practically every Supermarket car park and that vigilante idiots take it upon themselves to check for Badges, as well as PPCs also snooping for slipped Blue Badges (= easy money) too.

    A person who meets the definition of disability stated in the Equality Act 2010, and has the need to park in a disabled bay (because they have a chronic long-term condition that means they need to be very close to the store and/or need the wider bay) can park there. Blue Badge or no Blue Badge.

    The law is clear who is entitled to use 'reasonable adjustments' like these and they no more need a Badge than they need the word 'disabled' tattooed on their head like some sort of pariah. It is shocking that people still believe a BB is needed on private land IMHO, just because some signs say so.





    P.S. Just had a funny idea! These signs typically only say 'badge-holders' with a pic of a wheelchair user. So if you were a disabled person and parked there and got a fake PCN, you could happily fulfil the imaginary terms of that sign just by saying 'yes I am disabled and yes I am a 'Badge-Holder', which one do you want to see, my Blue Peter Badge, my footie team Badge or one of my old Scouts Badges?!' Could be an amusing exchange of letters before going for the jugular and suing the PPC and Supermarket for disability discrimination...

    I would say that if you broke your leg and are on crutches or something similar you are classed as disabled to a certain degree as well, so yes temporarily disabled but discriminated against because you have no badge, as Coupon says you can be disabled without a badge.

    I use the supermarkets quite a lot as I use them to take a break, and to get a bite to eat at times, I try to park away from near the entrance because the size of the vehicles, so quite often walk down by the disabled parking and see most if not all are displaying a badge, the contention that there is abuse is mostly unsubstantiated, most people don't take the michael its that simple,

    I agree in principle about allowing someone with a passenger with a broken leg to park there but they wouldn't be covered by the Equality Act. Has to be a longterm, continuing condition which is usually taken to be something which affects the person for a year or more.

    People covered by law and allowed to use a the reasonable adjustment of a private disabled bay include lots of conditions. Such as someone with cancer, or someone with ME, diabetes, any really longterm debilitating or incapacitating condition. In many circs they simply would not have a Blue Badge - could even simply be just because they have only recently been diagnosed, could be because they don't drive (but they do shop at Supermarkets with family who do drive...).

    Sadly they could not use a Council (real) disabled bay for reasons which are hard to understand - I guess statute covers the Councils.

    Nope. The Equality Act/EHRC guidelines on the definition of disability are quite clear. Wheelchair notwithstanding, any kind of short to medium term recoverable condition is not a disability.
