    rotoguys,
the OP dose not have a case, he is asking:

(In short do people reading this thread know of anyone, even one single someone who has been taken to a court of law for refusing / ignoring what is in law a Private Parking Company's speculative unsolicited invoice. If you do can you click one of the two buttons in the poll and if possible link me to any specific case / incident/ evidence / outcome URL etc.)

do you know anyone who has lost a case that has been well defended??

    Cheers Terry.

Surely they should provides some BB spaces, it doesn't mean that they have to provide free parking though, many do

As owners of private land, there is no obligation to provide anything!

Some do provide BB bays, some charge for them others don't.

    Defended against what?

A private company enforcing their rights to charge a fee to park on their land?

If you don't like the rules - park elsewhere!

All of my responses are relevant to the topic.

It is simple, if you don't like the rules and regulations when deciding to park a car on hospital private property, then park elsewhere.

Or pay the fee like everyone else.

If you follow this simple rules, the whole question of defending or objecting to a fee would have never have arisen.

In my opinion, no matter what the OP thinks or believes, they should pay up and not park there again if they think the rules and regulations are too harsh.

Finally why am I thought to be interested in knowing your name? My friends call me 'Don', but I do not class you as a friend, why would you think I am your friend?

    Wierd!!

And that is infantile!! It bears no relationship to the OP's question does it?

What is it supposed to be anyhow?

Let me explain it to you in simple terms.

No one is contesting the point that a landowner can charge to park on their land.

What is being contested and what has been proven to be quite factual is the point that, Landowners and PPC's dont have the right to charge exhorbitant fees if you overstay your parking, not have any legal right to impose 'Fines'.
Overstaying parking charges are based on an assumed contract that in fact doesnt exist, therefore the landowner or PPC are only legally entitled to reclaim any lost parking charges e.g £3.00 (in the case of my local Hospital)and not throw in alleged 'Fines' of £40 or more, halved if paid within 14 days etc etc etc.
Those claims simply do not stand up in Court, havent done and never will.
Got it now? good lad. Pip Pip!.

Parking companies do have some small wins, mainly due to default judgements by paid stooges, or losses based on not paying the parking fee.
My advice is if you should have paid a fee, send stamps to cover the fee by recorded delivery + £2.50 + postage for one letter, with a simple letter "from registered keeper without prejudice" Do not put names on anything.
It would be a very foolish of any PPC to try and claim a penalty where they had refused the loss.

    Link to these cases please?

The only cases I know of are from people who have literally hundreds of parking notices and the magistrates simply got fed up.
I know on no cases where a single pumped up 'Fine' has been supported in court.
No PPC will go to court to recover a simple lost parking fee of £3-£4 or so, they are Gangsters of the highest order, neither do they usually accept a payment of their losses of £3-4, so they try the old Parking Fine Notice.
