Can I claim for vouchers I have for a beuty spa now out of business?!

Hi! Can anybody please advise me ....

My husband bought me some gift vouchers for my birthday in September for a local beauty spa (£45). Unfortunately I couldn't use them right away as I am pregnant. We've just found out the business is now closed down (possibly bankrupt?). Is there any way to get our money back?!

    How did your husband pay for them?

    If by debit or credit card, consider a chargeback... read here.

    If by any other means, search out an administrator, if there is one.
    Maybe read MSE's Administration Help article.

    Who were the vouchers bought from?
    Direct from the spa or from a third party?

    It depends on a number of factors. Most important is the method of payment. If on a Credit Or Debit card then you dont have any legal protection (as s75 only kicks in after £100) however Visa and mastercard (and some banks) offer similar protection to section 75 as part of their service. If so then get in contact to find out how to claim.

    If it was cash then at best you will get little of your money back. If its a small one shop job then you have almost no chance of recouping money unless you take the owner to court (assuming they dont have some form of limited liability - Sole trader, partnership etc) which for £45 is effort. If the business is larger and has instructed administrators to take over then you need to contact them and log yourself as an unsecured creditor. This means they have it on file that you are owed money but you are at the bottom of the list to pay. Once the Administrators take their cut, and all secured creditors and taxes are paid, whatever is left if anything will be divided between all the unsecured creditors which is often only pennies to the pound.
    Back by no demand whatsoever.
