Faulty phone

Could someone please give me some advice,i purchased a Blackberry phone from Carphone Warehouse in October and after 8 weeks the charging port came out of the phone as i unplugged the charger,i took it back to CW and they said it was a cosmetic fault and want to charge me £170 to fix which i think is wrong.CW reluctantly sent it off to their repair centre to see if it could be done under warranty but came back unrepaired.I now have a broken phone which i cant use and am still paying for my contract with orange.Orange have been really helpful but their hands are tied as i didnt get the phone direct from them,they would of replaced the handset immediately.I feel like im banging my head against a wall and have tried everything to get this matter resolved but to no avail.Please can someone help me, Thankyou.

Have you called Blackberry about it?
Charging points are a weakness of any phone and can be easily damaged by the user - this is not covered by warranty - but BlackBerry may be more sympathetic...0 -

If BB refuse to repair under warranty (very likely), the only weak hope is to sue CPW as a supplier under the SOG Act and to claim that the handset was not fit for purpose. However the outcome is pretty unpredictable.
IMHO, all micro-USB ports of modern mobiles are not fit for purpose as they a soldered to tiny foil areas that are just glued to the motherboard.0 -
I have already tried contacting blackberry who said i have to take it up with the shop i purchased it from,CPW have said they didnt sell me the phone in that condition so i have to pay and its classed as cosmetic,surely a brand new 8 week old phone shouldnt of done this?0

The problem is in most cases this sort of problem is down the user forcing in or pulling out the charge cable. It may not be your fault in this case but it is in most cases. Warranty does not cover user damage.
As it's only 8 weeks old your best option would be to use the sale of goods act in the small claims court as grumbler mentioned as most places will put it down to excessive force by the user.
Try writing a "letter before action" stating they have 7 days to replace before you take action, I suspect it won;t work and you'll need to take the small claims court route.0
