Ebay - cash on collection problems!

Hi,
Ive recently sold an item on ebay, listed as used although description stated that other then being taken out of the box it was unused (which was true).
The winning bidder didnt want to pay the postage fee so came and collected it, I showed him the item working, he paid and left.
He has now contacted me saying that the item is cacked on one side (when I know it wasn't) and that he wants his money back, plus £10 to cover his travel costs.
He also mentioned that he could have purchased similar items closer to home for only £5, which makes me wonder if he just wants to get some money back as he has changed his mind about the cost he paid!
He has now opened a dispute as I said the item was fine when he collected it and didnt think I had to give him a refund as he had time to inspect it on collection. Not sure what to do next and what the rules are re cash on collection as cant find anything about this on ebay, any help would be great!!

I don't think you have to give him a refund, but obviously none of you can prove that the item was in perfect condition (do you have any pictures?). I'm afraid the only thing you can't escape from is a bad feedback...0

Thanks, thats what I thought - its only my word against his. I have one picture but it doesnt show the side he says is now damaged..typical!
If I did decide to offer him a refund if he returns the item via post to me at his own cost, surely I dont have to refund him the extra £10 travel cost that he wants too?? It was his choice to drive, and if I had delivered via courier as I planned he wouldn't be able to get this money refunded would he?0 -
Since he paid cash and inspected the item prior to paying, he has no rights to a refund. Ignore. You might get bad feedback though, but nothing you can do about it.0

Ebay have been known to allow a buyer to return a cash on collection item. So do not be surprised if he has the case rule in his favour. However, there is no way of knowing if he turns up or if indeed you do refund him as there is no paper trail of the payment.
Update the dispute to ensure that Ebay know this was cash on collection and the buyer inspected the item fully.
They may just give him a no fault refund.0 -
Thanks for the comments, have updated ebay and he has now replied saying that he wants ebay customer support to step in before he takes the matter to court....all seems a little over the top for an item which cost him £9.50 and was in the condition I described in the listing!! Wait and see what ebay decides now I guess...0

Just sit tight and let eBay make its ruling, and go from there.0 -
He' s just trying it on, it was his decision to take it away from your house thereby accepting its condition - stick to your guns and don't refund any money but be prepared for a negative.

Ebay ruled in my favour on this! yay! However I have just had the below email from the buyer - seems he just isnt gonna give up! Can he do this for an item which only cost him £9.50 (and the cost to drive and collect at his own choice)?? Its still only my word against his that the item had a small crack, he has never supplied evidence and I inspected it before listing....help!
Ebay will not intervene as I did no pay by PayPal.
In the circumstances, I am going to file a court claim for £19.50. I will also claim for all court and solicitors fees.
Although I have 6 years to issue the claim I am not going to wait that long and will do so without any further notice.
I am giving you one last chance to refund the money I gave you, £9.50. Please reply within 7 days. Afterwards the matter will go to court with all expense and time involved. Do you really want to waste your time defending your ground and risking paying a lot more than what you can pay now?

Personally, I'd be tempted to tell him that you get free legal any way and as such he could end up forking out for your legal bills while in turn you have nothing to pay for them if you lose.
But realisticly he is a chancer.
On the other hand I would be tempted to offer to paypal him £2 for his efforts as soon as he leaves positive feedback (which in my opinion is worth more than that - and he almost certainly will leave negative - unless he doesn't realise that you can't leave him negative). Whether you actually give him the £2 is up to you!There is no intelligent life out there ... ask any goldfish!0
