you can only scrap a car at an end of live registered place
they take your log book confirm by other means that you have title to scrap it and issue an electronic destruction certificate direct from dvla
you dont need to do any more
if you sold to mick and his advert from the paper advertising highest prices for scrap/damaged cars then you make him sign the top right hand section of your v5c saying car has gone into the trade and you post this ideally via registered post to swansea
reason being mick sold your car in the pub 20 minutes after you sold it and its now being used as a pool car by all and sundry scum
you will be liable for tax insurance etc for eternity
i would get advice from a solicitor so he can write a letter under oath for you sent to dvla

This has only been the case with the introduction of the latest type of registration documents. On the old ones a keeper could tick the box to say they had scrapped the vehicle and then send the V5 to DVLA. They would then show it as scrapped.

I've found it easler with the new ones.
Transfer to the new owner,(dealer in this case), give them the main part of the v5, then send off the tear off slip.
Either they do scrap it, and send you the destruction certificate, and it vanishes of the dvla database, or they don't, and you have sent off the tranfer ownership so it's their car anyway.

It can only come back to bite you if the dvla mess up, like here, and don't action the transfer.

Effective from 09/01/2012? Then you write a letter now, acknowledging reciept of this letter and you point out to them that you require it to be effective from 09/08/2011 giving them a copy of the letter you sent to them in October 2011. But this may not matter now....see below

However if the Continuous enforcement letter states the fine is becasue the car was not insured on 10/01/2012. And the date you ceased to be registered keeper is recorded as 09/01/2012, then you could tag on to the new letter that you expect them to confirm the CIE charge has been dropped as you were not the registered keeper on that date.

BTW did the January letter you wrote to them reference the October 2011 letter? i.e. "I've had no reply to my previous letter on 10/10/11" This would help your case in court if it does.

I also ask again why did you not take a tax refund? you must have lost out on about £80

Unfortunately, even worse - they did not get around to recognizing it until 19/01/2012. So still have a fight on my hands in regards to the Insurance Enforcement. I posted up what the October/January letters said on here before, they were pretty much carbon copies of the template I came across when I realised the V5 had not been processed but I sent the January one recorded delivery. I didn't get a tax refund as I never got the disc back, an oversight perhaps but it wasn't £80 left to run.

I can assure you that it was not 'Mick from the paper' and it would have been impossible to drive the vehicle in any case, so I am rest assured that it is not still out there somewhere. It was taken to a registered authorized treatment facility and I have confirmed this with the list on the local council's website.

I realise now that to minimise the risk of this happening I should have sent off the V5 registered post but hindsight is a great thing and nowhere does it say that you have to use this service legally as I would expect standard post to arrive.

So you sent them a letter dated 09/01/2012 recorded delivery and they have taken "the date they processed it" as the date you are no longer the keeper?

That is unacceptable, it should be taken from the date of the letter, or the date the letter was sent.
