Car phone warehouse refund refusal

Hi looking for advice please, I bought a phone for £199 in store around dec 28th it has stopped working despite little use and no wear and tear.
I took it back today and asked for refund but the shop manager said because it was bought over 14 days ago he could only offer a replacement.
Do I have the right to demand a refund ?

In my opinion, no. You have a certain period to inspect the goods, and reject them for a refund if they aren't working properly. The amount of time you get is only defined as "reasonable", and differs between goods. (The classic example is a pair of skis, bought in the summer - it would be reasonable to expect you wouldn't be able to inspect them for several months).
For a mobile phone, I would say (and this is my opinion, only a court could officially decide) that you would need enough time to make a phone call, to check the quality of the call, use the internet functions, check the volume of the sound, etc. Which wouldn't take quite so long.
Many retailers have certain periods to avoid any arguments, I see CPW has 14 days, which is shorter than many, but I think they are technically in the right here.Squirrel!If I tell you who I work for, I'm not allowed to help you. I bought the phone as a replacement for a faulty phone i had sent back to Dell, i was then going to sell the replacement i got from Dell.
Because i am using phone as a Wifi hotspot for my home broadband i need a phone to be working so when the CPW phone packed up on saturday night i had to open my replacement Dell and use that which now means it is not new for purposes of selling.
I was therefore going to keep on using the Dell and hoping to get a refund for the CPW phone. Hope that makes senseWHOOOOSHHHHHHHHH……..

Your reasoning changes nothing, they are fine to offer you a replacement.

I wasnt saying it was i just asked for advice.
CPW phone listed and sold on Amazon today for small profit.

Sorry but the comment being brutal and exclamation mark at end of sentence hints that the poster thought i was trying to gain from CPW.
I simply asked for advice, didn't moan about my treatment and only expanded on why i would have preferred a refund to be polite to the person who asked.WHOOOOSHHHHHHHHH……..
