    Just received my file from Experian, and this Lowell group, has also checked my file numerous times over the past year.

    My file is clean, but had an history which follows (which is now not on file)

    got into serious debt in 2002 of about £40,000 with 6 or 7 credit cards. Just stopped paying, never made any contact, so had defaults, CCJs, but as I recall not on all the debts.

    My current bank, actually gave me a credit card with £6000 on last year, so my history must have been good then, (although I did not apply for the card). Indeed was happy to receive it.

    Now I want to use the template in the OP, but I am in fear of making contact, and thus be liable for debts that did not go to court or were defaulted. So I will need to use 'Statue Barred' method, but I want to absolutely sure this tactic is going to work, and would be very interested in the author of OP response to this.

    I sent lowells a "prove it" letter about a month and half ago and got a speedy response saying they needed to trace my credit agreements and would be in contact once that was given to them, not heard 1 peep from them since, not by letter nor phone/text!!!

    I remember that if they do not give a satisfactory within 28 days, then you can ask by letter for one.

    Just a thought

    That's my concern, if it's not on my credit report now then it must be over 6 years old and therefore Lowells etc cannot go and suddenly default the debt again can they? Or apply for a CCJ? If its not on your file now, they can't add it again?

    A debt not being on your report doesn't necessarily mean it is statute barred.

    Defaulted accounts are removed 6 years after the original default date. That is a different 6 years than the statute barred one.

    For example, you may have defaulted at a certain date, but kept paying something for say a year after that. So 6 years after the default the account would be off your credit report, but as it was only 5 years since the last payment it would not be statute bared for another year.

    Also when debts get sold on to debt collectors, sometimes the default does not get updated or re-recorded against the new company. Meaning that it can disappear.

    However, if the debt/default is not on your file now because it has dropped off after 6 years from the default, no debt collector should re-add it. It is one default recorded against a debt in it's history allowed. Full stop. They can't add more once the original is gone.

    Might be an idea, and to explain a bit more about what you have received and the debt.

    May be best to send the SB letter. May be better to ignore if they are just "fishing". Maybe something else.

    If you explain then we can try to work out what might be best.

    Thanks fermi, so in a nutshell, if I didn't pay anything off and now it has dropped off after 6 years, it is statute barred?

    Sounds as if it could be assuming you never made payments.

    Only you can work that out though.

    Thanks again, have to be careful with my words, but if I send them the letter, can they be right bandits and put a new default on my account or apply for a CCJ just because they can?

    They can't do it accidentally on purpose for example just to stick the knife in?
  • i have been receiving letters from various people regarding a bank debt. these are unopened as i know where they originated... do i send the letters back unopened or just ignore them?
