e-bay refund

I purchased a gillet from ebay and arranged a return and refund with the seller as the item did not fit. I have not received a refund and have opened a case on ebays resolution centre. The status of the case is awaiting sellers action. I have an email from the seller to say she received the returned item and that she cannot refund me until ebay closes the case. I have contacted both the seller and ebay regarding my refund the seller does not respond and ebay say there is nothing they can do. I am completely confused as to why ebay cannot do anything as there is a case open and I have been trying to make contact with the seller for over a month.

    Do NOT close the case otherwise it's bye bye refund. At some point you need to escalate the claim. Post on the eBay board. They are smarter than me :)
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

    The seller is trying to pull a fast one here.

    They CAN issue a refund.

    What kind of case did you open? Was it a straight forward 'return-request'? Did you return it via tracked means?

    i opened a returns case not sure if it was tracked or not its the first time this has happened. i wont close the case but have given up all hope of a refund ebay just says they cant do anything. thanks for the links will try that

    Did you submit the details of the service used to return the item on the case?

    The seller must refund within 2 days of receiving the return (as stated on the sellers side of the resolution console), also includes an 'Issue Refund' button.

    How much money are we talking here?

    total of 62.99 and no didnt say who i used to return jacket, was royal mail not registered but i do have email from seller which says she had received it back.

    So, because you did not used a tracked service to return the goods, you cannot demonstrate to ebay that the goods have been returned.

    Ebay insist on electronic proof of return.
    The email from the seller will not sway ebay.
    You will not get a refund through the ebay process.

    Ebay are waiting for the seller to confirm receipt or you to add tracking.

    Without tracking to say its been delivered back - your in the hands of the seller, and are relying on them being honest.
