  • You are not likely to get any recompense from a toad who knows less than my cat about how to run his business properly. There are most likely all sorts of weasel clauses about "best efforts" "advice" "no liability" or "E&OE" .

    Don't spend any more time and effort worrying about this now, unlike another poster in a similar but far worse situation who has made a very grave error of judgement. What you must do now is expend all of them on ensuring you get these rubbish tenants out of your house. That is the only and most important thing. Recriminations, blame and all the rest can be thought of when you've got a decent agent putting a decent tenant in there.

    One not working, one with a ccj, guarantor who ignores you & pays up when they reach 2 months of arrears.

    Reserve that section 21 with the nla's help, & do it properly this time.

    Get all the paperwork from the agent, & ditch them ASAP.

    Don't readvertise, as you won't get this lot out easily.

    I think this site encourages tenants to become more "professional". For example, I've never been served with a S21 notice and I have had a fixed term contract before. Where another tenant had a tenancy starting the day after I moved out. It didn't suit me at all to move then and I ended up paying for a B&B for the next 3 weeks. If I'd known anything about my rights back then I might still be in the house now :p

    Thinking about it now, it's a wonder there aren't more problems with this. Student lets almost always run back-to-back onto each other. What happens when tenants don't move out when you expect?

    Try and find an agent who is recommended by a local professional landlord - by that, i mean someone who has at least 10 properties and who has been doing it a while - if that isnt fesible then try 'landlord zone'.

    Also, with the greatest respect to other posters im not sure that you should take what posters have said here as being the correct legal standpoint - some might be correct but some might not and i think 'landlord zone' or a legal forum might be safer if we're talking abou acceping well-meaning but potentially incorrect advice from someone who is not a legal professional. Or talk to an actual legal professional :-)

  • Grey lady: we've got many experienced and professional landlords on this forum, some of whom have posted on this thread. As the OP has now finally joined a landlords association I think it's likely that if he feels the need for confirmation of any information or advice he's been offered here by our well-meaning but potentially incorrect regulars he can get all the competence necessary there. Why clutter up another forum or waste time with the same questions?
