Paypal disbute - really upset and don't understand why case closed

I'm really upset because spent nearly £50 on a piece of furniture which hasn't arrived and Paypal have closed the case. I can't see an explanation why.
I bought an item on ebay mid December. It said to allow 6 to 8 weeks for delivery but it still hasn't arrived. I wasn't too concerned as he had positive feedback. I checked the other day and he suddenly had 10 negative feedback in the past month. At that I was getting worried. I emailed asking for a proposed delivery date but haven't had a response.
I then read that disputes via ebay need to be entered into within 60 days of payment and realised that tomorrow it will be 60 days! Then went to Paypal (who I paid through) to use their resolution centre. I filled in all the details and was a bit concerned that the seller may have closed paypal account when it immediately said it's not possible to liaise with seller and did I want to escalate. I said yes and processed that. I'm now upset to see that Paypal have already closed the case. This is what it says:

Does anybody know why this doesn't comply with filing policies?

I thought paypal claims had to be within 45 days? That might be why it's been closed?
AFAIK you can still do a claim for item not received through ebay though0 -
It is 45 days from date of payment for a paypal chargeback- 60 days for an ebay chargeback- this is maybe were you got confused .The seller maybe knew this and was using this to their advantage.
You could try for a credit card chargeback if you paid with your credit card through paypal.
It does say on the help pages-
- For most items not covered by PayPal Buyer Protection, eBay offers a standard purchase protection programme which provides coverage up to £120.00 (less a £15.00 service fee).- <LI style="MARGIN-TOP: 6px">Both the eBay and PayPal purchase protection program offer coverage when you pay for an item that you don't receive or when you receive an item that is significantly different from the item that was described in the listing.
- If you pay with PayPal on listings that are not covered by PayPal Buyer Protection, and file your complaint with PayPal, PayPal will provide the protection outlined by the eBay Standard Purchase Protection Program
Good luck- however with most cases like these the seller has withdrawn the money and done a runner.0 -
Try speaking to your credit card people about it. If you go thorugh ebay (which it may be too late to do) you'll lose £15 from the claim.My TV is broken!

Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
Thanks everybody for all your advice. I put a dispute through on ebay as well as paypal. On my dispute console it's saying dispute opened and the other parties action is needed. Do you think I should phone ebay also?
I have a credit card registered to pay my paypal account so I guess I should try them - haven't had this problem before so finding a bit daunting and feeling a total fool
The guys negative feedback has now gone up to 13 so I guess I'm not the only one which of course is no consolation. 0 -
did you use your credit card to pay for that item though.....not just on file to pay paypal....0

It's just on file to pay paypal so my credit card statement lists it as paypal. Does that mean i won't be able to make a credit card chargeback?0

not if you didnt pay for the item through your credit card
how did you pay through paypal?....from a balance that was in paypal already, by debit card, transfer from your bank account....or from your credit card?0 -
If you paid with your credit card then phone them up and tell them. Your credit card protects you against fraud just tell the credit card company you did not receive item and want to report it then they will able to recover costs on your behalf.0

Paypal is set up to just automatically take payments off my credit card when needed. I haven't sold anything for a while on paypal and had no money in my paypal account. When Paypal takes the payments from my credit card the statement says: Paypal Ebay(sellers name)(reference number).pennylane99 wrote:not if you didnt pay for the item through your credit card
