Cetificate of Completion of Works Certificate v NHBC Certificate

Am going through the conveyancing now on the purchase of a new build and am trying to avoid the lessons identified with the sale of my old place.

One of those was the provision of a certificate of completion of works signed off by the council for my old place. The buyers solicitor was adamant that I had to provide one....so I did

I have now asked my conveyancer to provide proof of certain things before I will exchange and one of them being the certificate of completion of works. They have come back to me and said you don't need it as the NHBC certificate is suffice.

All I want to avoid is any pit falls if and when I come to sell in the future. I have also noticed that on the plan of the property and boundaries there are 3 trees, one of which has an active TPO attached. In reality there are only 2 trees within the boundary and the one with the TPO attached is the one that has been cut down. I have asked the developer for formal proof of authorisation from the Council for the felling of the tree. I don't want to come across as obstinate but I don't want to create any issues for myself in the future.

Advice on the Certificate of completion of works and NHBC much appreciated.

    NHBC replaces the Building Control Approval certificate in the case of a new build built by an NHBC registered builder. They have their own inspectors. NHBC shows it is finished and guaranteed.

    If you carry out future work to a house that warrants it then you will need Building Control again.

    You can check the TPO issue directly with the Council - if permission for felling was granted it will be on record.

  • Your NHBC insurance certifcate will tell you whether they carried the Building Control on your home. Otherwise you should have a Completion Certificate (aka Final Certificate) from the local authority or an Approved Inspector (this is realtively unlikley if the developer who built your home is one of the larger builders who tend to use either NHBC or the local authority).
