Virgin threats

Hi,

I have a Pay Monthly number with Virgin, which is basically a pay as you go kind of thing.

i should have had a bill form them in August 2006 and the next quarterly one in Nov 06.

However i never got any and they reckon i owe them £120 for a 6 month period.

Ever since i got their first begging letter in Aug/Sep i have had regular contact by email, letter and phone. I have not avoided the issue!!

After 6 months, they still have not produced a bill, leave alone 2, to backup this amount.

Now it has gone to a debt agency, who are threatening bailiffs and court.

But i have not has any bill, so where do i stand?

Any help welcome.

    I would also contact the debt agency to inform them of the same information. They also have an obligation and would be liable for any action they take which would be knowingly in conflict to what you have claimed. It should be up to them to go back to their clients before proceeding with any of the actions you mention. The onus is upon them to prove you owe them money and the action you have taken so far sounds more than reasonable.
    Copies to trading standard office aswell.

    This is odd, as that sounds like an account that is normally settled by direct debit.

    Are you disputing the amount of calls, or just complaining about no bill and collection?

    Are you talking about a payg service.If so you should have got a bill every month not every quarter,and you would have needed to set up a d/d that would have been collected monthly.

    Did you cancel your d/d?
  • Tell the debt collection agency that you dispute the amount. They will then go back to their client who will have to produce evidence of the debt and the amount.

    Yes it had a d/d, but when they took the money without me getting a bill, i queried it and stopped the dd and did an indemnity claim.

    I have pursued a bill for 6 months and they can't produce it.

    Re: redux, yes i'm disputing the calls and the bill, as i have no idea if they are correct, i guess anyone in their right mind would query this if they cannot show evidence for what i SUPPOSEDLY owe them!!
