    How could the data protection act come into it?
    If the customer has told the shop that the game doesn't install, then by checking up on the serial number no personal data pertaining to the customer can possibly be obtained as no personal data could have been uploaded to the website in question.
    if your asked to give id details give a false one. no trace, no comeback, money in pocket.
    And if the purchase was made with a card payment of any sort?

    Plus, with software, they are quite within their rights to refuse to refund and only offer a replacement

    Refund is not the only remedy the retailer can offer you know. And if the OP paid by card........then yes there is a trace.

    I assume by Steam telling the shop that the key for the software has already been used. Whether that's a breach I couldn't say. I wouldn't have thought so.

  • The DPA can only be breeched if information is disclosed which can lead to the identification of the person to whom the data is related.
    By simply informing the retailer if a piece of software has been used or registered, there is no way that anyone could possibly be identified as no personal information has been released.

    Well asking whether software has been registered is not necessarily personal data and wouldnt therefore be covered by DPA.

    However, for arguments sake let's say it is personal info......I agree, I wouldnt say its a breach. For one thing, sharing information is not in itself a breach. Especially if there is a valid reason for doing so. The above poster reminds me of those people in shops who yell "I know my rights".
