    Yes. A recorded letter is on its way.

    And The Financial Services Ombudsman is going after my credit card company for not being as 'helpful' or as 'sympathetic' as the claim they are when e-commerce goes wrong!

    A point of interest is this, if X buys goods from Y and Y uses Z to ferry goods to X, and Z screws up. Y remains liable to X regardless of Z's position between X and Y.

    The same in not true for money. If X sends money to Y and the payment goes via Z then X and Z have one contract and Z and Y have another contract. There is no direct link between X and Y, so X cannot charge-back from Y.

    PayPal are better than NOCHEX because they put the merchant id on all credit card transactions allowing the credit card to perform a charge-back.

    But the problem with a charge back to paypal is that you would still owe the money to paypal. When you action a chargeback, it will take the money from paypal....not the retailer/seller. There has been quite a few posters on MSE saying they have dect recovery companies chasing them for this very reason.

    For section 75 to apply, there usually has to be a direct relationship between the card issuer and the retailer - hence why third party payments arent usually covered.

    However if the company are not making clear that payment is taken by a company other than themselves, to me its very underhanded.

    The whole experience has been underhanded in my opinion. But I have learned an awful lot for my troubles.

    The venomous bit is that TBDOL owes me less than £100, yet by the time I exhaust all my options, the entire process will have cost the Credit Card company, Consumer Direct, Trading Standards, The FSA, but hopefully TBDOL most of all, £,£££'s

    To be fair here, even if the payment wasn't through a third party, the CC company at this stage would have no grounds to allow a chargeback -- afterall a retailer can take upto 30 days to refund money and does not breach the 'performance' clause of DSRs until after 30 days also. So bearing in mind the short period of time since you have ordered, the retailer hasn't done anything wrong other than offer poor service (unless of course delivery was guaranteed by a certain date).

    Trading Standards are now going after the trader so he's in for an interesting 2012.

    All I can do at this stage is wait and hope that TBDOL act on my request for a full refund, though I think this is very unlikely.

    Meanwhile, all parties concenred are now aware that I will not hesitate to push it all the way until I run out of options or get a satisfactory conclusion.

    I'll share any further developments.

    Hi all I found this forum very helpful and hope I can now help others, I was interested in ordering a Philips clock radio and after trawling the internet found TBDOL to be offering the best price, I asked them a question about the item via their sales email address and received an answer within a few hours HOWEVER I then asked them to provide me with the following information before placing an order with them,
    1.How long has your company been established,
    2. Is your payment site a secure one.
    3. Do you have a contact telephone number.
    None of this information is available on their website.
    These questions were asked three days ago and they have not replied needless to say I have not placed the order with them, BUYER BEWARE
    I think these people should be reported but I'm not sure who to, would it be trading standards?

    Why do you suggest county court action?

    Calyjo has clearly said they have not risked any money with them...
