Goods not received from UK online store tbdol

Hi All,

Please forgive the use of a cryptic web url, but this forum prevented me from entering the actual url because I am a newbie.

I bought an item from an UK online store www tbdol co uk shortly after Christmas using a credit card and received an order confirmation via email.

As time passed I heard nothing about delivery or tracking information, so I contacted the trader a few times for delivery details.

This week I sent a third and final email to the trader emanding delivery details or exercise my right to cancel.

The problem I have is that the trader does not respond to any of my emails and that my credit card (who will usually do chargebacks whatever the amount) refuses to help because www tbdol co uk, unbeknown to me, processed my payment via a third party called NOCHEX!

I have not received my goods and I am out of pocket on my credit card. The trader does not reply to my emails, the credit card company isn't interested and NOCHEX are not replying to my enquiries either.

Consumer Direct have passed on my case to Trading Standards who are investigating.

I did a Nominet WHOIS lookup for www tbdol co uk and got this:-

I called 118119 for a phone number at that address but no numbers (residential, business or mobile) are registered.

What else can I do?

    You have an address.

    Why not write a letter... a real letter... remember them?

    It's a pity you have already send a final email, as now you cannot send any more. ;)

    Chargeback is not possible according to CC Company... :-(

    From that postcode the local authority will prob be Newham or Tower hamlets i would contact the trading standards team and see if the person is known to them and ask there advise.

    NOCHEX may issue the refund if no goods have been received (similar to Paypal) as I'm sure I've read on this forum of this happening before?

    Realistically, not that much time has passed, has it ? How soon is 'shortly after Christmas' ? If you discount bank holidays and weekends, there have been 11 working days since Christmas Day, and that's including the three days between Christmas and New Year when many small places simply shut down for the duration. They might not even have picked up your order until last Tuesday (3rd).

    I discussed this point with Consumer Direct too, but they said that I should have at least have heard something (and definately should have had a reply to my enquiries) by now.

    Consumer Direct looked all over the trader's website for a trading address but couldn't find one. So Trading Standards are now involved because, notwithstanding any other offences, the trader is in breach of E-Commerce Regulations.

    I have sent a recorded letter to the address I found, cancelling my order and demanding a full refund.

    So let's see...

    Question: Can I cancel a payment?

    Answer: Once a payment has been authorised it cannot be cancelled as Nochex processes all transactions instantly.
    If you require a refund for a purchase you have made or you have accidentally made a double payment please contact the merchant in the first instance (the email address is available on the payment confirmation email you received) and then let us know if you are still unable to resolve the issue


    Question: What happens if I send a payment and never receive the goods?

    Answer: Please make sure you trust the person you are sending money to, as successfull Nochex transactions cannot be cancelled by yourself.

    As stated in our terms and conditions:

    "Where you dispute a transaction between you and another party, NOCHEX will not enter into any payment disputed by you and any other person other than to confirm that the payment was made in accordance with the instructions you gave to us. We cannot arrange for money to be given back to you where you believe the payment was made incorrectly by you".

    "We are not responsible for any goods or services paid for by you using the NOCHEX service".

    You must understand that we cannot get involved with disputes between buyers and sellers.

    The exception to this is in connection with investigations by the legal authorities. In these instances, they can file a Data Protection Disclosure form with us. In these circumstances we are legally obliged to supply them with any information they demand.

    If you ever believe someone has acted criminally (deception, fraud or other) then we recommend you report it to the police and ask for their advice. If they want to speak to us then let us know and we will do all we can to co-operate.

    Basically, NOCHEX offer no buyer protection whatsoever and should be avoided at all costs!

    I'm going to try contacting the FSA because I had no idea that NOCHEX got involved between my credit card and the merchant and broke my possibility I had of requesting a chargeback.
