    If the networks make this agreement separate this doesn't change the fact that they supply both the services and the handset as a pack.

    So guys - what is the conclusion?

    Have I got no leg to stand on because I have no way of proving the fault was there at the time of manufacture?

    I understand that. If thats the case then it should have been tested in lab by 10+ years mobile have been about...

    Cars are sold on HP but the car ownership is seperated from the finance, why is this different.

    Not true. Section 75 combines liability together between seller and lender.

    Ask Three whether they dispute whether there was a durability defect at the time of supply. If they do, then get an independent report carried out (maybe by a repairer). You can then use the report to claim the cost of the repair and report from Three under Section 11N of the Supply of Goods and Services Act 1982.
