    Your wife is on contributory ESA WRAG. Unlike IB, C ESA WRAG is only given for 12 months and then her entitlement to be paid ceases, unless as a household, you are eligible for means tested benefits.

    If she was in the Support Group, her entitlement would continue as ESA Support group is not time limited.

    She will be entitled to back money of the difference between the £71 and the amount she was getting for IB.

    Do you work as if you do your income would stop her getting income based from a year since starting ESA. If however you think she could get into the support group then she will have one month to appeal and if succesful that would continue indefinately

    I do work full time but my salary is low as i have had to take a few pay reductions due to the" recession"
    If she was to appeal would she have to go in front of another board as i don't think she would want to go through that again.

    To appeal to get into the support group is the same process as appealling the original decision so yes it could well be.

    If you work full-time then she won't be eligible for income based as the amount deemed for a couple is far less. :(

  • It now takes upto 10 months for an appeal as they have a back log from wrong assessments and it's a reduced rate that would be given. My mum has had problems with the medical and they never really ask for your own doctors medical records as my mum found out with the hospital she is under so make sure you start the appeal straight away and don't let them only use the assessments you need your hospital records.
