Penalty points gone after 4 years, insurers ask for 5. Legal?

Motoring offences are not criminal convictions therefore do not apply to the Rehabilitation of Offenders Act. A FPN is still classed as a motoring conviction as the driver accepts the conviction when paying the fine therefore avoiding a court appearance.

Insurers will also require information about criminal convictions as well as motoring convictions but class them separately.

Motoring offences where you have been found guilty in court most certainly are criminal convictions. What they generally are not is recordable criminal convictions.

If you are prosecuted by the crown and found guilty, then you have been found guilty of a criminal offence.

Whilst they are not recordable convictions they still fall under the Rehabilitation of Offenders Act.
