Default nearly 6 years old

Hi all

I have a default on my credit history that is nearly 6 years old for a higher purchase that was with a company called yes car credit. Now I know that after 6 year the default comes off your report but does/can anything happen regarding the debt? and how likely is it to happen. Or is it just a case of Debt gone?

Does anyone know about Yes car credit and if there still around as i havent heard about them for years?

    Has the default been settled i.e paid off?

    If not, have you made any payments in the last 6 years or acknowledged the debt in writing?
  • No the default hasnt been paid off. I checked my credit history and the file was defaulted in april '06. I wouldnt have achnowledged by writing but not sure about any payments after april '06. is there a way to find this out?

    Also the car was repo'd around that time too.

    Try asking your bank for statements from April 06

    Your credit files should also have a record of payments (or recognition of the lack of them).

    So if no written confirmation and no payment in the last 6 years, what happens to the debt? can they still chase it?

    If the debt goes past April 2012 without payment or acknowledgement in the last 6 years then it will become Statute Barred. This means the creditor can not use the courts to make you pay. They can, however, chase you to pay the debt until you tell them it is SB and you won't be paying, after that they can be reported for harassment. The debt will always still exist, they just can't force you to pay.

    Oh ok, so i cant get a CCJ after being defaulted for 6 years? as long as no contact? as this is something i have heard?

    Think I wasted my life going to work 6 days a week to earn money to pay my way,settle all my bills when I should have just took on loads of debt and then refused to pay then wait till 6 years pass and although the debts still there they cant ask me to pay up.where did it all go wrong?
