Thanks everyone for your responses. my offence, for which i have no conviction for only an arrest (which surely makes me innocent anyway?) was section 39 common assault by beating which apparently carries a maximum of 6 months in prison.
i'm not a terrorist, drug taker/seller and sure as hell not a prostitute, you'd have to pretty unlucky to have to pay me for a 'good time' ha!

You may be innocent but thats not what the US look at! They don't seem to realise the "arrest first, ask questions later" approach in the UK.
I've heard that the embassy staff tend to ignore the arrest in relation to a visa issuance.

In any maximum sentence its the maximum under US law, in this case District of Columbia. If the offence occured in the US then its the maximum under the state where you committed the offence. That bits important, as petty offences could kick in depending on the maximum jail time. (Also penalties for crimes increase, so what could be a petty exception yesterday isn't today, as its calculated on the current possible maximum).
