Do not think for one moment that your nice guy landlord is going to stand for you not clearing every single penny of your rent and the loan before you vacate the property. If you choose to vacate. You could avoid all of this unpleasantness if you pay up, which is what he has asked you to do. That is perfectly reasonable whether you are a tenant or a lodger. If you are in no danger from him physically and he has shown no sign of being a ruthless batardo why are you contemplating trying to find weasel-ways to drop him in the mire? What has he done to deserve that apart from lending you money at a,lower interest-rate than you could get elsewhere? There might be only one bad guy in this scenario and it's sounding less and less like it's the landlord to me.0

I am going to pay the arears, im not trying to get out of it.Yes there was a written 12 month tenancy agreement when we moved in (it has the addresss on it)
What does that original tenancy agreement say about late charges for unpaid rent? (All of its terms will apply to your statutory periodic tenancy now running from month to month - assuming rent due monthly- except that you have to give one months notice, LL has to give you 2.)I am looking for somewhere else to live. Im not trying to get out of paying anything, he loaned me the money so I will pay him back and continue to do so if/when I move out.So, having 6 properties he rents out you would think he knows all the laws and legislations.

Get advice - proper legal advice, either from Shelter, CAB, or your council's Tenancy Relation Officer. You sound either very young, or unused to dealing with people. You have to be more wise in future, and learn from this. He sounds dodgy. Look for another place. And don't borrow money from people in positions of power.0

on a final note,
the guy wants to rent his house out. he should do so within the laws and legislation set down in regards to insurance, mortgate regulations, gas safty regulations, energy certificate.
and hell, if he isnt doing any of that i doubt he is even declaring any profits as an icome so im sure inland revenue would want to know as well!0 -
That high horse it too elevated for you and it's affecting your judgement. And your spelling. You are getting a roof over your head. One which you are currently not paying for. And your landlord has lent you money which you have not yet repaid. One wonders whether this loan was made before or after the rent arrears accrued. I think you're being a dog-in-the-manger. I have a deep-seated wish that the OP has disclosed enough information so that should their landlord come across this thread they will be readily identified. Imagine treating someone, who on the face of it has been decent and kind, to such a dreadful and ungrateful attempted plan. All the poor landlord has done is ask to be paid. I daresay the home he resides in is in his wife's name for tax reasons so he's keeping that room on in case he gets his bum kicked out one day. Stranger things have happened at sea0

So to sum it all up...
You borrowed money from your landlord, can't pay it back, got a month into arrears, can't pay the rent on time, and now want to try and weasel out of your obligations.
