Has anyone experience with receiving a fake item from Ebay?

I had a case before Christmas. Was told to return item to seller, but eBay did provide the postage label so I was not out of pocket. I left a neg to hopefully stop anyone else being taken in by that seller.

Had a phonecall earlier from the seller, she was a quite young girl by the sound of her voice... don't know what I was expecting. She basically said ebay had given her my number in the dispute so she was phoning me to explain about the purse... assured me that it is genuine blah blah. Basically contradicted every reason that I had given to ebay for believing it is fake. I asked her if she has a receipt or anything to prove that it's real... 'Oh I received it as a gift so unfortunately I don't have anything like that'. So I said well if it was a gift, how come most of your feedbacks are for Radley items? You must be buying them somewhere to sell on? 'Oh well sometimes I manage to buy one cheaply and make a couple of pounds on it on ebay'. Also she said if I want to I can return it for a refund, despite her auction page saying she doesn't accept returns... could this be because she has no proof of the purse being genuine, to provide to paypal?

The seller NEVER needs to prove authenticity to Paypal. The onus is on the BUYER to prove it is fake.

Is your case with ebay or Paypal as it will make a difference? I thought it was Ebay, but I cannot see where you confirm this.

Sorry I thought it was the seller who had to prove it. Seems a bit odd that the buyer has to prove it? The case is through ebay.

Should I just accept her offer of a refund then? I wouldn't want to send back until I have my money though, in case she just keeps it.
Is there an option in a dispute to let ebay know I am returning the item for a refund?

Whatever you do, if this is a fake, it must be destroyed, but only when you are refunded and told to do so.

Actually, I very recently claimed for an fake makeup item. Ebay had to interceed after the 40 something days were up and I did have to send the item back to the buyer! I was very surprised at this. So don't destroy your fake item! If you file your case threw ebay then it is down to the seller to prove the item is real.

This is not complicated.

eBay requires the seller to prove the item is authentic.

Paypal requires the buyer to prove the item is fake.

Do not confuse the two.

Do nothing until told by whichever company you have the dispute open with.

As for pearl122, I can only conclude you did not open the correct case.

She may have opened the correct case. I did. And was still told to return the fake item. The seller even admitted that they "didn't know" whether it was genuine or not in the case. So eBay don't always tell you to dispose of a fake.

Hence my caveat above; go with eBay and you may have someone reviewing who isn't au fait with their own T&C! Point them out and it's clear.

I would suspect that ebay may be refunding these cases from their own funds. Bear in mind, this buyer "believes" the item is fake.
This policy could lead to a scammers paradise. I have genuine designer gear for which I have no receipts.

Sorry for my spelling mistakes. I'm dyslexic and if I write something too quickly I'm more likely to make errors.

I definately opened a SNAD. And repeated in my correspondance that the item was a fake!
