Has anyone experience with receiving a fake item from Ebay?

Hi everyone.

Unfortunately I have received what I believe to be a fake item from Ebay. Just wondered if anyone has any experience with what happens in this circumstance? (I have opened a not as described dispute on ebay).

The item in question is a Radley purse (and a very convincing fake at that...) but having done some research online and on the Radley official website there are many signs suggesting the item is not genuine.

    Your options are simple.

    If Radley or an authorised reseller will give you written evidence that the item is fake, then you should open a PayPal dispute once you have proof. You must open the dispute within 45 days of purchase and upload proof within 10.

    If you cannot get this proof, then you may try an eBay case for fake (not SNAD). The onus in their T&C says the seller should provide proof it is authentic. However, eBay staff are not well versed in their own T&C. But if they stick to them, you will be told to destroy the item, once the dispute is near resolution.

    Either way, you should not be returning anything to the seller.

    Thanks for the reply.

    I read online that Radley will not give evidence of fake items if they were bought on Ebay, as they do not agree with them being sold on there due to the number of fakes.

    I have opened a dispute already and have chosen the option for 'counterfeit item', which was available to me after going through the 'snad' option.

    Radley may not, but perhaps House of Fraser or Debenhams? If not, then you have to go via EBay. Outline the fact you feel it is fake and ask the seller for evidence it is authentic, quoting the eBay T&C if you can within the dispute.

    Also will ebay refund me before telling me to destroy the item? I wouldn't want to destroy it only to find they have changed their mind and want me to send it to them or something.

    Explain in the dispute why you think it is fake, ask the seller for proof it isn't and quote the eBay terms. Then wait for eBay to tell you what to do.

    Ok will do. Have just had an absolute rollicking from the OH when I read him the bit about ebay telling me to destroy the item :-/ says I have no right as it belongs to the seller if I get a refund and that I should send it back to him even if I lose out on postage costs!

    It is unlawful to send a counterfeit item through the post. Perhaps you should show your OH the thread on here about the violin that Paypal told the buyer to destroy.

    Whatever you do, if this is a fake, it must be destroyed, but only when you are refunded and told to do so.

    You have to escalate a case. Then it is reviewed by eBay staff. If the decision thn doesn't go in your favour, come back here for help.
