    You dad is having a rough time of it but it seems par for he course for them. To give a refund is no slower than placing a withdrawal. Instead of pressing the sale button they press the refund button but most of the rest is the same. You may well have gone through a refund process in a shop when returning an item (not something I do often but my wife does!!)

  • Thanks dunstonh... yea dad has been through a rough year with that tucan scam mob... but at least hes getting somewhere now... after i emailed john mann MP he kindly forwarded dads plea of help onto our local MP cathy jamieson who got in touch with dad.. and also my emails to the ministry of justice have been aknowledged with them kindly replying in email and letter. saying there collecting lots of evidence (emails/letters from tucan to customer) from consumers so that when they take tucan to a first tier tribunial in a few weeks... theyl hopefully have enuff evidence from consumers to stop them trading again... so we are getting there!

    PROGRESS!!

    REALLY HOPE THIS WILL STOP TUCAN DEAD IN THERE TRACKS... AND NO-ONE ELSE WILL BE DUPED OUTA MONEY AGAIN .

    I've been trying retrieve £249.99 from Tucan since September. They say they tried to refund my card through Cyberbit on 14 December. My credit card company can't dispute this until they have written confirmation they tried to refund the card. I've been phoning every other day since before Christmas to try and get this letter, but get excuse after excuse. Today, they say they'll send it recorded delivery and will call back later with the tracking number - I'm not expecting to get that call. Where do I go from here?
  • Tell the credit card company you want a refund under Section 75 of the Consumer Credit Act 1974.
  • IMPORTANT UPDATE;

    Dads credit card has been back in touch saying that because tucan claims used there merchant company -( cyberbit secure payments of denmark) to take the money out of his account,,, that dad is not actually covered by the ***" a refund under Section 75 of the Consumer Credit Act 1974."****
    anyhow they will reimburse his money for now... and they will take up the case of trying to get the money back from cyberbit,, but if they dont succeed , they will take the money back off dad ,,,

    ANYONE GOT ANY ADVICE ON THIS MATTER?

    on dads credit card statement it said payment of £249.99 to CYB/TUCANCLAIMS...

    is this correct that hes not covered under this act ??
  • OH AND ALSO TUCAN CLAIMS PHONED DAD YESTERDAY TO SAY THEY WOULD HAVE NO MORE DEALINGS WITH HIM AS HIS CREDIT CARD LEGAL TEAM ARE NOW DEALING WITH IT...
    the cheek of tucan claims!!! they werent very helpful at the best of times!! GRRRRR

    In that case tell the bank no authorisation was given to Cyberbit to debit your account (if authorisation was given at all it was only to Tucan who did not give any indication that you needed to authorise somebody else to debit your account) so you want a refund in accordance with FSA rule BCOBS 5.1.11

    I was notified in December 2011 that Tucan Claims were unable to recover any compensation for PPI for us. When I asked for my £249.99 to be refunded I was told "it had gone to review but was being dealt with". Today I was phoned by Tucan Claims to say that I should get in touch with my credit card provider and ask them to pursue the matter for me by opening a "resolution". I have written to my credit card company enclosing paperwork relating to my dealings with Tucan Claims and relevant email communications.

    It was a this point I looked on this forum to find I am not the only one in this situation. I have passed the info re Cyberbit on to my credit card company and only hope they will be able to recover this money for me.

    I realise I was foolish to part with the money (I was totally taken in) and will never ever do anything like this again. I feel such an idiot now.

    I can't believe this company can continue in business with so many complaints levelled against it.
