    But a 'month' can straddle 2 calendar months! So 15th - 14th counts as does 22nd - 21st, not just 1st to 28/29/30/31.

    Accrual of leave - whether statutory or contractual - is based on service in the period, so such a clause in in breach of the intent of regulations on the way that leave is accrued. They may get away with it because the difference is minor and most people can't be bothered (if they know about it) to argue about it. But certainly most local authority terms and conditions I now see (and I do see a lot of them!) have shifted to accounting for leave on an hourly basis as I said. So all leave is expressed in hours no matter what your working pattern, and you are entitled to actual hours accrued / in debit on leaving, at whatever point you leave.

    Thanks for all these responses although they seem to have settled on one aspect.
    Anyway, to add and therefore help clarify, my OH's annual leave is calculated in hours not days.

    He will have accrued 30 years plus 296 days.His birth date and therefore retirement date will be the 05/06/15. The actual A/L entitlement is 33 days plus BH's. Normally when someone leaves the NHS they can take payment in lieu of A/L, or at least this was the case some years ago.

    Does he work a non-standard working week?

    A/L should only be applieded in hours if he doesn't work 37.5hrs over 5 days.

    No - as I explaiend earlier it is very common with some employers. There is no reason why someone has to work non-standard hours to have their leave entitlement calculated in hours. It allows for gretaer felxibility and for accurate leave entitlements to be calculated on any given day.

    OP - I am not really sure what else you want to know?

    Actually you've all answered my question, I only added more info because the conversation seeme to have focused on one area and I was trying to answer some of the questions raised such as his entitlement is worked out in hours etc.

    He does work a 37.5 hr week so they obviously do use this method,Thanks all.
