    NHS (and local authority) employees are fortunate in that they receive more than the statutory minimum amount of paid leave. The employer can therefore choose to apportion holiday on complete calendar month only basis - as long as by so doing the employee receives a full entitlement to statutory holiday for the part month (which will be the case because of the extra organisational holiday entitlement).

    Agenda for Change Terms and Conditions set out that holiday is only accrued for whole months, it is a holiday allowance in excess of statutory minimum.

    A small number of NHS Trusts may have a local policy of prorating to the day but most do not. The National Staff Record System (ESR) calculates entitlement accruals on whole months.

    As someone that has left the NHS, I can confirm that accrued annual leave is calculated on a daily (or hourly, for part time staff) basis.

    But a 'month' can straddle 2 calendar months! So 15th - 14th counts as does 22nd - 21st, not just 1st to 28/29/30/31.

    It can as the passage of time but AFC holiday years commence 1 April and the t's and c's refer to calendar months.

    Interesting though that the Barrister here tells us that it is unlawful to calculate leave in that way. Maybe they get away with it because everyone lets them.

    His a/l* entitlement after 10 years service is 33 days -afc table 7, leave entitlement. I would expect him to receive around 5.5/6 days pro-rated (depending on when he leaves service).

    Is he given a choice between receiving payment or having the pro-rated days deducted from his retirement date? - may be worth discussing any possible pension affect of this with a steward.
