    The branch hasn't closed. The OP has moved away and is no longer near a gym.

    In the past there was a Total Fitness near where they have moved to, but it had closed before they moved.

    I'm reading it as in it's closed since moving back to the area, hence why if the contract was re-assigned to that specific gym op may have grounds to cancel. However, if it has closed before moving (which re-reading you may be correct) then I would agree op has no grounds to cancel as the contract would still be assigned to the open branch. Although it does sound like its a company wide membership allowing op to use any branch.

    Suggests to me that the OP moved to Cheshire, joined the Cheshire club, then moved back to Liverpool. As the Liverpool club closed in May/June, and the OP didn't move until July, they wouldn't even be able to argue that they intended to move back to Liverpool and make use of the old club.

    The only get out would appear to be if the OP joined the Liverpool club before it closed, then transferred membership to the Cheshire club. If that was the case then you're right that they could claim their own club closed, but it doesn't read that way to me.
