Total Fitness Cancelling Membership

Hi,

We took out membership in total fitness in July 2011 as we'd moved to the cheshire area, we have now moved to back to Liverpool but Total Fitness in Liverpool was shut down so the closest one is at least 30 minutes away.

Do we have any way of cancelling our contract? I rang the guy and he came up with a figure of £100 to cancel early which seems a bit odd. As we've out of the area are we within our rights to want a cancellation?

    The answers are probably in the T&C you agreed to when you signed up to the gym. You probably need to read through your paperwork.

    We have moved house, we'd be VERY lucky to find any paperwork regarding the gym unfortunately, does no one have a copy that has just signed up?

    I'm sure someone will be along shortly, however the T&C may vary from those you agreed to at time of signup. Meanwhile have you checked their website for any T&C's or cancellation terms?

    It would depend entirely on the contract - under general law, you're not.

    You've chosen to move away from where is convenient, so Fitness First haven't done anything wrong to warrant a cancellation of contract under law. You'd have to check the wording of the contract for cancellations - with things like this it's usually it's the remainder of the contract (maybe minus 10%/5% etc.)
  • Really think there should be something in place for situations where you move out the area, its not exactly my fault they closed the liverpool branch. 6 months left in a gym that we cant use! lovely

    I believe Total Fitness have now opened up or are in the process of opening a new branch in Liverpool, in the Aintree area.

    Aintree one has been there for a while, but thats on the other side of liverpool to me, still half an hour away, they had one in edge lane which was about 10 minutes away, but that closed last may/june.

    Does the contract state the actual gym on or just a multi-venue membership? If the former i'd say you would have grounds to terminate the contract as they are now unable to fulfil their side of the contract (again depending on the terms. Although since you've moved i'm assuming you're not restricted to one venue in which case I think you will struggle to get out of it.

    arcon5 - even if it was a single gym, I don't see what difference it would make. The gym are still perfectly capable of, and willing to, fulfil their side of the deal regardless of whether it's a single or multi club membership - the OP can still go to any club they're entitled to use. The fact that they moved to a location that makes that inconvenient for them isn't really the gyms problem.

    Actually it makes a big difference. If op has contracted to a specific branch then that branch closing means they are unable to fulfil the contract.
