Perhaps if he's prepared to be decent to you, and you both decide not to sell the property or he remortgage right away (although I don't necessarily think this would be wise) maybe he could be persuaded to give you a small income monthly in lieu of the equity you own until either of those two things happen?

This might be a better strategy for you in the short-term because as soon as you have x amount in savings other benefits can cease to apply. *thinking out loud*

Can I add a little twist to my scenario, I didn't think of this when I initially posted. We have a buy to let home too, on an interest only mortgage, we have tenants in there who are horrendous payers. Mortgage and insurance for them is about £250pcm, but - could I say to my hb I want to go and live there? we are both on the mortgage there - can he stop me? I previously lived in the house for 13 years and so so so regret putting his name on the deeds, but in order to take the equity out to buy our current house, the mortgage provider wanted him jointly on the deeds - so I agreed............stupidly! Thank you.
