Also if you used a credit card to fund the paypal payment you can do a chargeback on that with your credit card issuer. Regardless of what paypal say.
If you can do without a Paypal account then its worth trying. Paypal have been known to close accounts when people have gone down the chargeback route.

don't know if it would be much use, but maybe contact gumtree to let them know that this guy is using their site to scam people. might stop it happening again.

Gumtree would probably recieve about 3000 emails a day about scammers if everybody did that. They can't fail to know that the siteis full of scammers, so obviously don't care.....Not saying you shouldn't email them, just that i doubt it'll achieve much

paypal offer protection through ebay, not gumtree.

    Wrong, wrong and wrong again!!!

Every purchase made through PayPal is protected(as long as it is a purchase, not sent as a gift), I'd open an Item Not Received dispute in PayPal ASAP, then, if he does, and he may well do, sends you an empty recorded envelope, the you can claim SNAD (significantly not as described)

Apologies for giving the wrong information.
Not trying to contradict anyone here, but what Are the chances of the OP actually getting their cash back? None, I'm guessing. (but I hope I'm wrong!)

If he opens a PayPal dispute, very likely

The OP has an excellent chance of getting their money back, the paypal protection will kick in for INR.
Oh, and Ebay own Gumtree and Paypal.

Provided that the purchase was eligible for buyer protection and the OP followed the requirements, then they should get their money back irrespective of whether the seller still has the money in their account or not.

Paypal will issue the refund themselves and put the sellers account into a negative balance and then possibly chase them for the money.

Hi. Thanks everyone for your replies. I e-mailed him again yesterday and he didn't reply by midnight, so I opened a dispute. He sent me an e-mail immediately (within minutes) asking why I had done so, and responded on PayPal telling me to close the dispute or he'd have to report me to PayPal, also giving me a tracking number. I checked the tracking number on Royal Mail and it doesn't work, i.e. there are no details on it, as compared with details of posting on a recorded letter I sent the other day. I said I'd close the dispute once the tickets arrived. He is now saying he's going to contact the police unless I close the dispute. He linked postoffice.co.uk, on which website's track and trace the number produces this result:

Your item is being processed but we have not received confirmation of delivery.

My brother insists the number is fictive because it doesn't produce anything on RM but what does that mean if it does work on the postoffice website? I wasn't aware there was any difference so I'm now confused. He's denying that he received any e-mails from me, which I really think extraordinarily unlikely (b/c sent in the usual way, to the same address) and says he can take a screenshot to prove it (which is ridiculous). Does anyone have any idea what the track and trace result above means from postoffice.co.uk (i.e. has he actually sent something)? I think he's srsly overreacting to the dispute, saying that he'll report me to the police if I don't close it by 9 pm etc. but then uhh... I'm confused if he's actually sent something (e.g. as to why he would stop contact). If anyone knows what the above means that that'd be good. Sorry for my stupidity. Don't worry, I won't be repeating this in the future (buying from GT with PayPal, that is). Thanks.

Just occurred to me that a tracking number doesn't necessarily prove anything? If it doesn't arrive I mean. I have no idea. Anyway I'm just going to leave the dispute open.

Let him report you to Paypal, they won't do anything. Its scare tactics that in my mind make it seem even more like a scammer.

It is possible if its been sent via business post. I send recorded items through my business and the tracking does not show until its been scanned as delivered. However, in your situation and with all the evidence I think it adds more weight to him being a scammer.

LOL!! He's an idiot and the police will tell him politely where to go!! More scare tactics - more evidence of being a scammer!! Tell him he his more than welcome to contact the police and you look forward to their call (they will never call you!).

    See above about tracking

But he received the Paypal payment and the Paypal dispute notification on the same email address!! What a card!! Politely decline his offer of a screenshot - it means nothing.

    As above

The dispute doesn't go against him until you escalate it so if he's genuine then he wouldn't have anything to worry about. It all points to a scam in my mind and he's trying to scare you into closing the dispute and then you will never get your money back. If it was me I would tell him to f**k off for being a prat and will close the case once the tickets arrive but I would suggest that you just reply with facts via the Paypal case only and ignore everything else, including any emails he sends you.

The only thing you need to be aware of is the time-scales for escalating the claim if the tickets do not arrive.

Hi, thanks so much for your help agaaain lovinituk. I can escalate to a claim from the 9th so I'll keep a note of that. I sent him a message just saying that he had not responded to any e-mails that I'd sent before the dispute, and that he was welcome to phone the police but I'd only be escalating to a claim if the tickets didn't arrive / that I'd close the dispute if they did. He responded saying he'd never received any e-mails and that I'm low life scum, that I could keep the tickets and the money (though no mention of refunding me) etc. etc. Which was kind of weird, but anyway what I'm more concerned about is that he's deposited £1 into my PayPal account - why would he do that?? I'm worried he's going to open his own dispute or something (er, unless this is the money I can 'keep'). Should I just refund it?
