Please could someone settle an argument.

A few years ago, January 2009, I drove past a car in a garage and caught it very slightly. It was so slight that the woman said there was no damage to her wing at first then she spat on the paintwork and rubbed it with her glove and said there was a dent. I could not see the dent but I exchanged insurance details with her. Not a mark on my car.

My husband was hopping mad that I gave her the details especially as a few weeks later we got a letter to say that the repairs to her bodywork cost £600. Anyway that is besides the point.

Since then every time I have insurance renewals on my car I have to declare my 'accident' and it has cost me dearly for the past three years.

My husband drives a work van and he has been declaring it on his insurance too and paying more. What I want to know is, should he be doing this as the accident was to the other car and not to his van? Should we both be paying more car insurance to pay for this 'accident'. I say no and he says that if he lies on his insurance application we could be in serious trouble. He had an unblemished driving record for about 30+ years before this.

Am I in the right area to ask this question.

    The reason I am asking this is that he is now renewing his van insurance and one of the questions is have you had a claim in the last 5 years.

    I don't understand why he is declaring it. He didn't have the accident (or are you insured on his van too?).

    No, I am not insured on the van. He says any claim on either car should be declared.

    The car is in his name on the car insurance and I am a named driver of the car. I am not named on the van insurance. He says because I don't have insurance in my name then the claim is his and must be put on the van insurance.

  • correct he should be declairing it, it was his policy that the claim was made against and you the named driver was at fault. he's had no accident but has a claim against his policy.

    My OH was involved in an accident in my car as a named driver. Like your husband I declared the accident on my insurance as I thought as everything was in my name it was my claim. When we spoke with the insurance company they said I didn't have to declare it as I wasn't involved/hadn't claimed, it was my OH that needed to declare it. Speak with the van insurance people and see what they say :)

    I agree to speak to the van insurance to find out exactly what they want to know from him.

    The post above sounds a bit odd. if there was a claim on Debsy's insurance policy for a named driver accident then yes, Debsy should be declaring a claim on every renewal. If the same driver is still named and there was no claim made, then an accident should be declared against his name on every renewal.

    Tell the insurer the exact circumstances of the accident and let them decide, but on the face of it I would say Yes this does count as a valid claim and he's correct to be declaring it.
