landlords mortgage arrears

Genuine mistake upon opening mail which was for the landlord,ive never recieved mail here for her,thats why i automatically thought it was for me in a state of panic to read someone from NCI resources was going to visit over mortgage arrears,and visit they did that day,i was asked if i was the landlandys name i said no,i told him my name,he asked how long i lived here,how long my contract was for,how much rent i pay,how i pay it,what was the condition of the property was(not good another long story so not on really good terms with the landlord he also told me to open any mail adressed to the occupier,does anyone know how much arrears she would be in to recieve this kind of visit making me wonder if a case is being built for repossession,i just dont know,me and my husband are on the list for housing from the housing association,have been for nearly a year as we have children too,but really dont know what we are going to do now,could anyone advise me on any of this,ive even sent an envelope to my address today with the landlords name on it,to see if it comes back as she may have had mail redirected and that one slipped through as surely her lender must have sent letters over arrears,i also read up on if there is no BTL so we would be unauthorised tenants,sorry for the rambling,i really am worried,we have no more money for anywhere else,so i know we would be homeless and we would have to go to our local council,any advise please,like a cat on hot bricks worrying whats going to happen next.

    If the LL has a Buy To Let mortgage, or has Consent To Let from the mortgage lender, then IF the lender repossesses, they have to take over the tenancy and become your landlord.

    If not, the when the lender takes the LL court for repssession, you can ask the judge for 2 months grace to find somewhere. See the

    Look out for letters addressed to 'The Occupier' as you have to be informed of court case.

    I was asked if I was the Land ladies name, I said no.

    Sorry it was a bit difficult to read your post.

    Open any further letters addressed to The Occupier. You will have to attend anyhearings to make sure the courts/bank are aware that you are a tenant in the property.

    There are plenty threads about this on the forum.

    Don't panic too much if you have an AST then you will be protected and they can't just kick you out they will have to serve you proper notice. Start saving what you can and looking for somewhere else.

  • Nothing will happen really quickly. If the lender does decide to repossess that will most probably be what the "To The Occupier" letter will be telling you. Being in receipt of an eviction notice could put you right at the top of the HA's list when you've got kidlets.

    Come back when you've received the letter. That could be the time to stop paying your rent so you can save for your onward move, but maybe not.

    We have just over a month left on our fixed contract,
    then go to periodic,sorry not too good on the computer and first posting,just dont how much arrears shes in for this visit.thank you both.

If the mortgage-lender does repo you could get only a month's notice if you're on a periodic. Still, that doesn't mean that you can't flash your Section 21 Notice in the direction of the HA when you get one if you're still there.

    bitter and twisted i had the feeling that its a fair bit due to a visit and suspisions on the nci bloke telling me to open mail addressed to the occupier,i hope it is 2 months as being on the housing list will bide me time to bid on properties and hopefully at least put a roof over me and my families heads alot quicker,really worried though as to not knowing what going on.she wanted more rent money after the 6 months were up no way will i give another penny,also as i pay standing order its not even in the landlords name totally different.
