Stuck with o2 contract

I have it in writing from an advisor at o2 saying my contract is up feb 2012. I contacted them today to say I didn't want to renew the contract but they are now telling me the advisor made a mistake and my contract is not up till 2013 and if I want to leave I have to pay them £500.00, they told me that having it in writing means nothing its not legal or something.

anyone know if there is anything I can do?

  • I'm not an expert but ''in writing'' is the most solid evidence you can get. Mobile phone suppliers would not (99% certain) take any action because they would look like idiots. I would call bluff.

The most solid evidence is the original contract. If an advisor makes some mistake later, this doesn't override the original contract.

Of course, you should take issue with the fact that anyone said your contract would ever be 'up'. It most certainly would not, as it would continue regardless until you asked them to cancel it.

If you meant how long your minimum commitment would be, that's a different matter. You have no need to renew a contract, it will continue anyway. Your contract will state the minimum term, so take this as your bible - unless you added, changed or upgraded, then this date cannot be changed without your express agreement.

Deep down, you know what length of contract you signed up for. If you don't, then you are negligent.

If your contract is due to end in February 2012, then get out the paperwork and get on to CS again.

If it is 2013, then the fact that a CS made a typo does not let you off your agreement and, rather than being "stuck" with the O2 contract, you are simply completing it.

That's the answer to your question.
