Help with dodgy parking ticket please
Hi All,
I recently received a Penalty Charge Notice citing 46: Stopped where prohibited (on a red route or clearway).
I have since gone back to the same place to check the signs. There is a RED ROUTE sign where you can park for 20mins loading between 10-4pm. My car was filmed on CCTV CAMERA as being on the red line after 4pm.
However this sign is quite some distance from where my car was actually parked. On the day itself it was dark and raining and there is no way it was clear.
In any case i had not even finished parking before a traffic warden knocked on my window. I asked if it was possible to just offload some charity bags into the shop right there. She said no - you couldnt park there and to go round the corner.
Therefore I immediately drove off.
My argument lies in the fact that this traffic warden clearly saw what i was doing and in her judgement it did not constitute an offence (i was stopped for 5secs if that for our conversation) otherwise she would have given me a ticket.
However, TFL used CCTV to zone in on my number plate and are now trying to charge me.
They have quoted the Traffic Mangement Act 2004.
Is anyone familiar with relevant legislations / reasons which have been used before to challenge TFL.
Would they dispute the existence of this traffic warden as the photos literally just show my number plate, the corner of my car, the kerb and nothing else ?
Any help would be much appreciated.

You cannot stop on a red route. Not ever, not even for a minute, not even to drop someone off for 10 seconds. The only time you can stop on a red route is if you've broken down or in an emergency or where indicated by signs. It is even mentioned in the Highway Code. It is an absolute offence.
The stopping for loading in a red line area is in dedicated bays, not on the red lines, and it was for a specific time which you were outside of.
You were caught bang to rights. Pay the fine.0 -

What poor advice!
As suggested above, go to www.pepipoo.com and post this there. There are some very knowledgeable members there who are very familiar with TfL and their tactics. They will be able to give you an objective assessment."You should know not to believe everything in media & polls by now !"

The whole point of some roads being designated Red Routes is that they are main traffic arterial through ways and there is no stopping on them at any time with the exception of an emergency. If you do not know this you deserve all resultant penalties that comes your way.

The question is, why was the council using CCTV if they were also using CEOs? The guidelines state that CCTV should only be used in areas where CEO enforcement would be difficult or sensitive.0 -

In which case, it might be useful if the OP were to make a FOI Act request, to find out how many tickets were issued by CEO on that road in, say the last 12 months, and how many by CCTV.0
