What will happen to my mobile phone?

    they'll sort that soon as they know your bankrupt...so dont worry about it nobodys' going to think your a crook etc and if you did sell the handset etc to pay off bits this could land you in more trouble as you could be seen preffering a creditor

    speak to o2 give them a heads up & see if they'll allow you to transfer your number to a PAYG sim that way it'll still be active...but bear in mind another contract will be VERY difficult to obtain till your at least discharged from BR at a later date

    Ok, i'll speak to O2. I'm still filling in the forms and haven't spoken to the court yet to make an appointment to petition for bankruptcy, so shall i wait a bit till i have a date etc or just accept the fact and sort it now?:(

    And I'm assuming signing up for another contract with a free phone from another network before bankruptcy is a big no no!?

    I have my OR interview next week but at this stage I've not been asked about my Tesco (O2) phone contract and I've received nothing from them. Maybe it will happen soon, I don't know but I'm not saying anything about it unless specifically asked.

    As "Phil" has said it would be up to the OR to decide if you contract monthly tariff is excessive or not. If your contract is cancelled the termination charges would be included in your bankruptcy.

    As others have said I'd be careful doing anything to your current contract or taking out any others. The OR may well come down on you for inappropriate behaviour.

    Don't worry, i'm taking all this advise firmly on board and won't do anything until instructed to by the OR or O2!

    I've dug my battered old iPhone 3G out from the bottom of the drawer though to get it "ready for action" just in case :o

    Probably. I've not heard from them yet, but it is early days for me. I'm hoping that if they do sniff me out, that since I'm more than half way through my 2-year contract that they will allow me to stay on, or at least let me keep the handset.

    Thats another question i have! I mostly paid for my phone, so how come O2 can claim it back just like that? I don't owe them money and have NEVER defaulted on any payments with them!

    I can understand the OR wanting to sell the phone, but not to just give it to O2?!

    Its not just O2 - 3 cancel your contract if you even go on a DMP so I'm guessing they arent BR-friendly either - they failed to tell me this and were forced to write off a £750 debt due to the way they behaved..

    If they want the phone back then 1. they're going to have to come and collect it as I wont be posting it anywhere 2. I can't guarantee what condition they'll get it in.
